HOUSE BILL NO. 333

AN ACT TO AMEND TITLE 9 OF THE DELAWARE CODE RELATING TO THE ENFORCEMENT OF AN ORDER TO CONNECT TO A SANITARY SEWER.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend §6517(b), Title 9 of the Delaware Code by inserting the phrase "in a Justice of the Peace Court in Sussex County" between "action" and "in the Court".

SYNOPSIS

This legislation enables the Sussex County government to proceed in either Justice of the Peace Court or the Court of Chancery to compel connection of a property to an existing County Sanitary Sewer District.
