HOUSE BILL NO. 305

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DELAWARE ENERGY ACT.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend §8059, Title 29 of the Delaware Code by adding thereto a new subsection as shown by underlining as follows:

(l)The Delaware Sustainable Energy Utility is deemed an "agency" under §6902(1) of this title and is subject to the State procurement laws of Chapter 69 of this title.

SYNOPSIS

This bill clarifies that the Delaware Sustainable Energy Utility is deemed an "agency" and not a "covered agency", as those terms are defined in 29 Del.C. §6902.
