HOUSE BILL NO. 3

AN ACT AUTHORIZING THE OFFICE OF MANAGEMENT AND BUDGET TO PARTNER WITH A FINANCIAL INSTITUTIONS AND COMMUNITY NON-PROFITS TO ESTABLISH A TEMPORARY LOAN PROGRAM FOR DELAWAREANS EMPLOYED BY THE FEDERAL GOVERNMENT WHO ARE AFFECTED BY THE PARTIAL FEDERAL GOVERNMENT SHUTDOWN.

WHEREAS, the Federal government has been operating under a partial shutdown due to a lapse in appropriations; and

WHEREAS, this shutdown has resulted in an estimated 500 Federal employees who reside in Delaware who are furloughed or working without pay; and

WHEREAS, a “Federal employee” means a Delaware resident who is an employee of a Federal government agency;

WHEREAS, the lack of pay for Federal employees due to the shutdown has resulted in significant hardship for furloughed and unpaid Federal employees and will have an adverse impact to the Delaware economy as a whole; and

WHEREAS, the Federal government has enacted legislation guaranteeing back pay for furloughed and unpaid Federal employees once the shutdown is resolved; and

WHEREAS, it is appropriate for the State to partner with financial institutions and non-profits to provide limited and temporary financial assistance to affected Federal employees.

NOW, THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):

Section 1. The Office of Management and Budget is hereby authorized to partner with financial institutions and non-profit providers to establish a temporary loan program for Federal employees who are Delaware residents and furloughed or unpaid due to the partial Federal shutdown.

Section 2. State assistance pursuant to said authorization may include the provision for a loan guarantee that may not exceed $80,000.

Section 3. The Office of Management and Budget and the Office of the Controller General shall review and approve program details prior to the commitment of State funds.

SYNOPSIS

This Act authorizes the Office of Management and Budget to partner with financial institutions and non-profit providers to establish a temporary loan program for furloughed and unpaid Federal employees as a result of the shutdown caused by a lapse in appropriations.
