AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO ANIMAL CRUELTY |
SECTION 1. AMEND Title 11 of the Delaware Code by adding a new �1325B to read as follows:
"�1325B Unlawful Public Sale of Dogs and Cats
(a) It shall be unlawful for any person to willfully sell, trade, barter, display, or offer for sale, trade, or barter, as part of a commercial transaction, any live dog or cat on any street, highway, public right-of-way, commercial parking lot, public park, or at any swap meet, flea or farmers market, parking lot sale, carnival, or boardwalk.
(b) Subsection (a) does not apply to:
(1)Retail sales by a pet store on the premises of a pet store.
(2) Sales by a publicly operated or private not-for-profit pound, humane society, animal rescue organization, or organization or agency whose mission is the adoption of homeless and abandoned dogs and cats..
(c) A person who is found responsible for a violation of this section is subject to a civil penalty not to exceed $150 for a first offense and a civil penalty not to exceed $500 for any subsequent offense."
SYNOPSIS

This bill makes it unlawful to sell or trade a cat or dog in an open-air market, including public highways and streets, commercial parking lots and flea markets.This bill does not apply to nonprofit pounds and similar organizations, nor does it apply to rodeos, county fairs and similar events.This bill does not create a criminal offense.Instead, a person found by a court to be in violation of this statute is subject to civil fines. |
