HOUSE BILL NO. 200

AN ACT TO AMEND TITLE 15 OF THE DELAWARE CODE RELATING TO ELECTIONS AND IDENTIFICATION.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 49, Title 15, Delaware Code by adding a new section to read as follows:

"§ 4949.Identification requirement.

(a)                 Every elector, upon entering the polling place, shall present to the election officers one of the following current and valid picture identifications:

(1)     Delaware driver's license;

(2)     Delaware identification card issued by the Delaware Department of Transportation;

(3)     United States passport;

(4)     United States military identification; or

(5)     other government-issued identification.

(b)                 If the picture identification required by subsection (a) of this section does not contain the signature of the elector, an additional identification that provides the voter's signature shall be required.

(c)                 If the elector fails to furnish the required identification, the elector shall be allowed to vote a provisional ballot.The Board of Canvas shall determine the validity of the provisional ballot.".


SYNOPSIS

This bill is a companion bill to a constitutional amendment to allow the General Assembly to determine photographic and signature identification requirements to vote.This bill is modeled after Florida's law.Thirteen states currently have approved such identification requirements (Florida, Georgia, Hawaii, Idaho, Indiana, Kansas, Louisiana, Michigan, South Carolina, South Dakota, Tennessee, Texas, and Wisconsin).
