HOUSE BILL NO. 15

AN ACT PROPOSING AN AMENDMENT TO ARTICLE VIII OF THE DELAWARE CONSTITUTION RELATING TO SPENDING INCREASES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):


Section 1.Amend Article VIII of the Delaware Constitution by adding thereto the following:

"Section 12.Adoption of Budget Appropriation Bill.

§ 12.Budget Appropriation Bill spending increases for a fiscal year that rise above the rate of inflation for that year may not be adopted except with the concurrence of at least three-fifths of all members of each House.".




SYNOPSIS

This is the first leg of a Constitutional Amendment requiring a Budget Bill that has a spending increase above the rate of inflation be approved by at least a 3/5ths vote of all members of each House.
