HOUSE BILL NO. 12

AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO SCHOOL NURSES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §1310, Title 14 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

(c) To the extent that the funding formula outlined in subsection (b) does not provide for 1 school nurse per facility, any school district or charter school may receive state funds for a nurse to be employed for 10 months to meet the requirement of 1 school nurse per facility.An application process shall be established by the Department for school districts and charter schools to receive such funding. The provisions of this subsection shall be subject to the availability of funds in any fiscal year. If funding is not available for all school districts or charter schools that have applied and meet the requirements of this subsection, the Secretary of the Department of Education upon the approval of the Office of Management and Budget and the Controller General shall make a determination as to which school districts and charter schools shall receive available state funds.Any school district that receives state funds for a school nurse pursuant to this subsection may use a match tax in accordance with §1902(b) of this title to provide for the local portion of funding needed to pay for any school nurse. All school nurses hired pursuant to this subsection shall meet the licensure and certification requirements of chapter 12 of this title.


SYNOPSIS

This bill seeks to ensure that every public school in the State of Delaware has a nurse. This bill provides a mechanism to allow public schools that currently do not have a school nurse to receive state funds. The bill also allows for a match tax to assist those school districts that acquire a nurse as a result of this bill to pay for the local share of that nurse.
