A resolution to propose to the people of the State of California an amendment to the Constitution of the State, by adding Article XXV thereto, relating to housing.

SCA 9, as introduced, Gonzalez. Personal rights: right to housing.
The California Constitution enumerates various personal rights, including the right to enjoy and defend life and liberty, acquiring, possessing, and protecting property, and pursuing and obtaining safety, happiness, and privacy.
This measure would declare that the fundamental human right to housing exists in this state. The measure would specify that it is the shared obligation of state and local jurisdictions to respect, protect, and fulfill this right through progressively implemented measures, consistent with available resources, within an aggressive but reasonable timeframe.

Resolved by the Senate, the Assembly concurring, That the Legislature of the State of California at its 2021-22 Regular Session commencing on the seventh day of December 2020, two-thirds of the membership of each house concurring, hereby proposes to the people of the State of California, that the Constitution of the State be amended as follows:

 That Article XXV is added thereto, to read:

Article  XXV Right to Housing

SECTION 1.
 The fundamental human right to housing is hereby declared to exist in this state. This right ensures access to adequate housing for all Californians. It is the shared obligation of state and local jurisdictions to respect, protect, and fulfill this right through progressively implemented measures, consistent with available resources, within an aggressive but reasonable timeframe.
