An act to add Section 49452.6 to the Education Code, relating to pupil health.

SB 97, Roth. Pupil health: type 1 diabetes information: parent notification.
Existing law requires a school district to provide a type 2 diabetes information sheet developed by the State Department of Education to the parent or guardian of an incoming pupil in grade 7, as specified.
This bill would require the department to develop type 1 diabetes informational materials for the parents and guardians of pupils, as specified, and would require those informational materials to be made available to each school district, county office of education, and charter school through the department’s internet website. The bill would require, on and after January 1, 2023, school districts, county offices of education, and charter schools to make those materials available to the parent or guardian of a pupil when the pupil is first enrolled in elementary school, or as part of a certain notification. By imposing additional requirements on school districts, county offices of education, and charter schools, the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:


SECTION 1.

 Section 49452.6 is added to the Education Code, to read:

49452.6.
 (a) The department, in coordination with any other entity the department deems appropriate, shall develop type 1 diabetes informational materials for the parents and guardians of pupils. The informational materials shall be made available to each school district, county office of education, and charter school through the department’s internet website.
(b) On and after January 1, 2023, the governing board of a school district, county board of education, and governing body of a charter school shall make the type 1 diabetes informational materials accessible to the parent or guardian of a pupil when the pupil is first enrolled in elementary school, or with the information provided pursuant to Section 48980.
(c) Information provided to parents and guardians pursuant to this section may include, but shall not be limited to, all of the following:
(1) A description of type 1 diabetes.
(2) A description of the risk factors and warning signs associated with type 1 diabetes.
(3) A recommendation regarding those pupils displaying warning signs associated with type 1 diabetes that the parents or guardians of those pupils should immediately consult with the pupil’s primary care provider to determine if immediate screening for type 1 diabetes is appropriate.
(4) A description of the screening process for type 1 diabetes and the implications of test results.
(5) A recommendation that, following a type 1 diagnosis, parents or guardians should consult with the pupil’s primary care provider to develop an appropriate treatment plan, which may include consultation with and examination by a specialty care provider, including, but not limited to, a properly qualified endocrinologist.

SEC. 2.

 If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
