An act to add Chapter 3.7 (commencing with Section 105245) to Part 5 of Division 103 of the Health and Safety Code, relating to pesticides.

SB 89, as amended, Weber Pierson. Pesticide use: glyphosate. Glyphosate: prohibition on sale.
Existing law regulates the use of pesticides and authorizes the Director of Pesticide Regulation to adopt regulations to govern the possession, sale, or use of specified pesticides, as prescribed. Existing law provides that the regulation of pesticides is of statewide concern and that the state occupies the whole field of regulation regarding the registration, sale, transportation, or use of pesticides to the exclusion of all local regulation.
This bill would prohibit, on and after January 1, 2028, the sale of a product that contains glyphosate in this state, except to a person or business that holds a valid license or certificate issued by the Department of Pesticide Regulation. The bill would require the department to levy a civil penalty of $100 for each violation of this prohibition.

Existing law regulates the use of pesticides and authorizes the Director of Pesticide Regulation to adopt regulations to govern the possession, sale, or use of specified pesticides, as prescribed.

This bill would state the intent of the Legislature to enact subsequent legislation to restrict the use of pesticides containing glyphosate for nonagricultural purposes.

The people of the State of California do enact as follows:


SECTION 1.

 Chapter 3.7 (commencing with Section 105245) is added to Part 5 of Division 103 of the Health and Safety Code, to read:
CHAPTER  3.7. Glyphosate

105245.
 (a) On and after January 1, 2028, a product that contains glyphosate shall not be sold in this state, except to an individual or business that holds a valid license or certificate issued by the Department of Pesticide Regulation.
(b) The Department of Pesticide Regulation shall levy a civil penalty of one hundred dollars ($100) for each violation of the prohibition in subdivision (a).

SECTION 1.

It is the intent of the Legislature to enact subsequent legislation to restrict the use of pesticides containing glyphosate for nonagricultural purposes.
