An act to amend Section 760 of the Harbors and Navigation Code, relating to vessels.

SB 883, as introduced, Monning. Vessels: for-hire operators’ licenses.
Existing law requires an operator of a for-hire vessel, as defined, to obtain a valid license to operate a for-hire vessel on the waters of this state, except as provided. Existing law defines for-hire vessel to include a vessel propelled by machinery carrying more than 3 passengers for hire, except as specified. Under existing law, a violation of the provisions governing the licensing of an operator of a for-hire vessel is a misdemeanor.
This bill, for the purposes of those provisions governing the licensing of an operator of a for-hire vessel, would revise the definition of for-hire vessel to instead include a vessel propelled by machinery carrying one or more passengers for hire, except as specified. By expanding the scope of a crime, the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that no reimbursement is required by this act for a specified reason.

The people of the State of California do enact as follows:


SECTION 1.

 Section 760 of the Harbors and Navigation Code is amended to read:

760.
 As used in this article, “for-hire vessel” includes any a vessel propelled by machinery carrying more than three one or more passengers for hire, except the following:
(a) A sea plane on the water.
(b) A watercraft specifically designed to operate on a permanently fixed course, the movement of which is restricted to or guided on such that permanently fixed course by means of a mechanical device on a fixed track or arm to which the watercraft is attached or by which the watercraft is controlled, or by means of a mechanical device attached to the watercraft itself.

SEC. 2.

 No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.
