CHAPTER 77

An act to amend Sections 41001, 41002, 41003, 41004, and 41006 of the Government Code, relating to local government.

SB 742, Moorlach. City treasurers.

Existing law prescribes the powers and duties of the city treasurer.

This bill would revise those powers and duties by deleting gender-specific personal pronouns and by making other conforming changes.

Existing law requires the city treasurer to comply with all laws governing the deposit and securing of public funds and the handling of trust funds in his or her possession.

This bill would require the city treasurer, if the city has issued bonds, to use a system of accounting and auditing that adheres to generally accepted accounting principles.

The people of the State of California do enact as follows:

SECTION 1.

 Section 41001 of the Government Code is amended to read:

41001.

 The city treasurer shall receive and safely keep all money the treasurer receives.

SEC. 2.

 Section 41002 of the Government Code is amended to read:

41002.

 (a) The city treasurer shall comply with all laws governing the deposit and securing of public funds and the handling of trust funds in his or her possession.

(b) If the city has issued bonds, the city treasurer shall use a system of accounting and auditing that adheres to generally accepted accounting principles.

SEC. 3.

 Section 41003 of the Government Code is amended to read:

41003.

 The city treasurer shall pay out money only on warrants signed by legally designated persons.

SEC. 4.

 Section 41004 of the Government Code is amended to read:

41004.

 Regularly, at least once each month, the city treasurer shall submit to the city clerk a written report and accounting of all receipts, disbursements, and fund balances. The city treasurer shall file a copy with the legislative body.

SEC. 5.

 Section 41006 of the Government Code is amended to read:

41006.

 The city treasurer may appoint deputies.
