BILL NUMBER: SB 699 INTRODUCED BILL TEXT INTRODUCED BY Senator McGuire FEBRUARY 27, 2015 An act to amend Section 58509 of the Food and Agriculture Code, relating to food banks. LEGISLATIVE COUNSEL'S DIGEST SB 699, as introduced, McGuire. Food banks: Food Bank Advisory Committee. Existing law establishes the Food Bank Advisory Committee and requires the committee to advise the Department of Food and Agriculture on the establishment of new food banks and to advise on the adequate and efficient distribution of surplus food commodities to all areas of the state. Existing law requires that the committee be comprised of, among other members, 2 food bank representatives from the northern portion of the state and 2 food bank representatives from the southern portion of the state. This bill would specify that the northern portion of the state is the area located above 37 degrees north of latitude and that the southern portion of the state is the area located below 37 degrees north of latitude. The bill would expand the committee's duties to include advising the department on the merging and separation of food banks within the state. The bill would also make nonsubstantive changes, including recasting some provisions of existing law. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 58509 of the Food and Agricultural Code is amended to read: 58509. (a) (1) TheSecretary of Food and Agriculturesecretary shall consult with the Food Bank Advisory Committee, which shall be made up of four food bankrepresentatives, two from the northern portion of the state, all of whom have been active members of a nationwide network of food banks for a minimum of two years immediately prior to appointment, and two from the southern portion of the state, all of whom have been active members of a nationwide network of food banks for a minimum of two years immediately prior to appointment,representatives and two food industry representatives,one wholesaler and one manufacturer,all of whom shall be selected by the Governorand referred to as the Food Bank Advisory Committee. (2) The food bank representatives shall be comprised of two representatives from the northern portion of the state and two representatives from the southern portion of the state, all of whom have been active members of a nationwide network of food banks for at least two years immediately before appointment. For purposes of this section, the northern portion of the state is the area located above 37 degrees north of latitude and the southern portion of the state is the area located below 37 degrees north of latitude. (3) The two food industry representatives shall be comprised of one wholesaler and one manufacturer. (b) Members of the committee who are not state employees shall be paid per diem for their actual expenses in attending committee meetings. (c) The committee shall do all of the following: (1) Advise theDepartment of Food and Agriculture indepartment on the establishment of new food banks. (2) Advise the department on the merging and separation of food banks within the state.(2)(3) Adviseinon the adequate and efficient distribution of surplus food commodities to all areas of the state.
