An act to add and repeal Section 4100.3 of to the Welfare and Institutions Code, relating to mental health.

SB 565, as amended, Jones. State Department of State Hospitals: facility expansion: report.

Existing law establishes the State Department of State Hospitals and provides that the department has jurisdiction over the specified facilities, including, among others, Atascadero, Coalinga, Metropolitan, Napa, and Patton State Hospitals.

Existing law, the Lanterman-Petris-Short Act, authorizes the appointment of a conservator of the person, or of the estate, or of the person and the estate, for any person who is gravely disabled as a result of mental disorder or impairment by chronic alcoholism. Existing law requires a conservator appointed pursuant to these provisions to place the conservatee according to specified requirements and authorizes the placement to include certain facilities, including, among others, a state hospital.

This bill would require the department to submit a report to the Legislature no later than August 1, 2022, regarding the anticipated cost of expanding the capacity of its facilities to reduce wait times for patients to be admitted to a department facility to a variety of levels. The bill would repeal this provision on January 1, 2026. department, on or before July 1, 2022, to develop a plan to expand the capacity of its facilities to reduce wait times for a person committed to a department facility pursuant to the Lanterman-Petris-Short Act to 60 days or less. The bill would require the department, on or before July 1, 2022, to submit to the Legislature a copy of the plan and a report regarding the anticipated cost of implementing the plan. The bill would require the department, on or before January 1, 2027, to implement that plan.

The people of the State of California do enact as follows:

SECTION 1.

 Section 4100.3 is added to the Welfare and Institutions Code, to read:

4100.3.

 (a) (1) On or before July 1, 2022, the department shall develop a plan to expand the capacity of its facilities to reduce wait times for a person committed to a department facility pursuant to the Lanterman-Petris-Short Act (Part 1 (commencing with Section 5000) of Division 5) to 60 days or less.

(2) (A) On or before July 1, 2022, the department shall submit to the Legislature a copy of the plan developed pursuant to paragraph (1) and a report regarding the anticipated cost of implementing the plan. The department may submit a copy of the plan and the report as a single document.

(B) A report to be submitted pursuant to subparagraph (A) shall be submitted in compliance with Section 9795 of the Government Code.

(b) On or before January 1, 2027, the department shall implement the plan developed pursuant to paragraph (1) of subdivision (a).

The report shall include the anticipated costs of expanding department facilities to reduce wait times to a variety of levels, including, but not limited to, reducing the wait time for a person committed to a department facility pursuant to the Lanterman-Petris-Short Act (Part 1 (commencing with Section 5000) of Division 5) to 60 days or less.

(b)(1) A report to be submitted pursuant to subdivision (a) shall be submitted in compliance with Section 9795 of the Government Code.

(2)Pursuant to Section 10231.5 of the Government Code, this section shall remain in effect only until January 1, 2026, and as of that date is repealed.
