An act to add Section 5815 to the Civil Code, relating to common interest developments.

SB 451, as introduced, Stone. Common interest developments.

Existing law, the Davis-Stirling Common Interest Development Act, defines and regulates common interest developments, which are managed by homeowners’ associations.

This bill would prohibit an association from being liable to any person because the governing documents of the association do not contain a provision that would authorize the association to stop harassment of a member by another member.

The people of the State of California do enact as follows:

SECTION 1.

Section 5815 is added to the Civil Code, to read:

5815.

No association shall be liable to any person because the governing documents of the association do not contain a provision that would authorize the association to stop harassment of a member by another member.
