LEGISLATIVE COUNSEL'S DIGEST
Existing law establishes the Milton Marks “Little Hoover” Commission on California State Government Organization and Economy (Little Hoover Commission) to promote economy, efficiency, and improved service in the transaction of the public business in the various departments, agencies, and instrumentalities of the executive branch of state government, and in making the operation of all state departments, agencies, and instrumentalities, and all expenditures of public funds, more directly responsive to the wishes of the people as expressed by their elected representatives.
This bill would state the intent of the Legislature to enact legislation that would lessen the time, effort, money, and programmatic expertise of local public sector workers in compliance with state reporting and permit processing, as specified.

The people of the State of California do enact as follows:
SECTION 1.
The Legislature finds and declares all of the following:SEC. 2.
Chapter 5.7 (commencing with Section 51020) is added to Part 1 of Division 1 of Title 5 of the Government Code, to read:CHAPTER 5.7. Automated Decision Systems
51020.
For purposes of this chapter, the definitions in Section 1798.140 of the Civil Code apply, unless otherwise specified in this chapter, and the following definitions apply:51021.
If a local agency uses an automated decision system to confer supportive services, including eligibility services, benefits, and assistance, permits, or licenses for which the recipient applies or would have otherwise had to apply, not including competitive determinations, the local agency shall comply with all of the following:51022.
The Government Operations Agency, in collaboration with any other state agencies the agency deems appropriate, may develop, adopt, and make publicly available guidance for a local agency’s use of automated decision systems consistent with this chapter. Before issuing the guidance, the agency shall notify the Joint Legislative Budget Committee of its decision to issue guidance.51023.
The Government Operations Agency may provide technical assistance to local agencies to comply with this chapter.(a)It is the intent of the Legislature to enact legislation that would lessen the time, effort, money, and programmatic expertise of local public sector workers in compliance with state reporting and permit processing.
(b)It is the intent of the Legislature that the legislation described in subdivision (a) would do both of the following:
(1)Emphasize systematic, rather than one-off, burden-reduction initiatives, using machine learning tools to capture and analyze data, and to deploy methods of nonlinear processing of nondiscretionary permits.
(2)Require workers and end-users to
participate fully in technological deployment to support responsible and effective implementation.
