An act to add Section 67384 to the Education Code, relating to public postsecondary education.

SB 367, Hurtado. Student safety: opioid overdose reversal medication.

The Donahoe Higher Education Act establishes the University of California, which is administered by the Regents of the University of California, the California State University, which is administered by the Trustees of the California State University, and the California Community Colleges, which is administered by the Board of Governors of the California Community Colleges, as the 3 segments of public postsecondary education in the state. The act applies to the University of California only to the extent that the regents, by appropriate resolution, make it applicable. Existing law requires the governing board of each community college district and the Trustees of the California State University, and requests the Regents of the University of California, in collaboration with campus-based and community-based victim advocacy organizations, to provide, as part of established campus orientations, educational and preventive information about sexual violence to students at all campuses of their respective segments.

This bill would require the governing board of each community college district and the Trustees of the California State University, in collaboration with campus-based and community-based recovery advocacy organizations, to additionally provide, as part of established campus orientations, educational and preventive information provided by the State Department of Public Health about opioid overdose and the use and location of opioid overdose reversal medication to students at all campuses of their respective segments. The bill would require the governing board of each community college district and the Trustees of the California State University to require that each campus health center located on a campus within their respective segments apply to use the statewide standing order issued by the State Public Health Officer to distribute dosages of a federally approved opioid overdose reversal medication, and apply to participate in the Naloxone Distribution Project administered by the State Department of Health Care Services. Upon approval for use of the statewide standing order and participation in the Naloxone Distribution Project, the bill would require a campus health center to distribute a federally approved opioid overdose reversal medication, as specified. By imposing new duties on community college districts, the bill would constitute a state-mandated local program. The bill would request the Regents of the University of California to comply with these requirements.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:

SECTION 1.

Section 67384 is added to the Education Code, to read:

67384.

(a) The governing board of each community college district and the Trustees of the California State University shall, and the Regents of the University of California are requested to, in collaboration with campus-based and community-based recovery advocacy organizations, provide, as part of established campus orientations, educational and preventive information provided by the State Department of Public Health about opioid overdose and the use and location of opioid overdose reversal medication to students at all campuses of their respective segments.

(b) The governing board of each community college district and the Trustees of the California State University shall, and the Regents of the University of California are requested to, require that each campus health center located on a campus within their respective segments apply to use the statewide standing order issued by the State Public Health Officer to distribute dosages of a federally approved opioid overdose reversal medication, and to participate in the Naloxone Distribution Project administered by the State Department of Health Care Services. Upon approval for use of the statewide standing order and participation in the Naloxone Distribution Project, a campus health center shall distribute a federally approved opioid overdose reversal medication obtained through the Naloxone Distribution Project in accordance with its terms and conditions.

SEC. 2.

If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
