An act to add Section 66027.7 to the Education Code, relating to postsecondary education.

California Community Colleges: remedial coursework.
Existing law, the Donahoe Higher Education Act, establishes the 3 segments of public postsecondary education in this state, including the California Community Colleges, administered by the Board of Governors of the California Community Colleges.
This bill would require the California Community Colleges to provide for entrance counseling and assessment or other suitable means to fully inform an incoming student, prior to that student completing registration, of any remedial coursework the student will be required to register for or complete and the reasons for the requirement. requirement, exemption policies, and the availability of any test preparation workshops or programs.
By placing additional duties upon a community college district, the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:
SECTION 1.
(a) A recent Public Policy Institute of California report found that remedial education placement policies at California Community Colleges vary widely across the state’s 113 campuses. These variations include using different cut scores at individual campuses despite using the same placement tests and some variation in the use of high school grade point averages and completion of college level courses.
(b) The Public Policy Institute of California report also found that all campuses of the California Community Colleges have a retesting policy in place, but the amount of time that students must wait to retest varied widely from no wait time to three years wait time.
(c) The Public Policy Institute of California report also found that campuses of the California Community Colleges had different exemption policies and that students may not be aware of their right to challenge a placement in remedial education courses.
(d) It is the intent of the Legislature that campuses of the California Community Colleges provide an incoming postsecondary student with suitable information, prior to that student completing
registration, to be fully informed of any remedial coursework the student will be required to register for or complete and complete, the reasons for the requirement. requirement, exemption policies, and the availability of any test preparation workshops or programs.
