An act to add Section 25402.15 to the Public Resources Code, relating to energy.

SB 1430, as introduced, Melendez. Energy: building standards: photovoltaic requirements.

Existing law authorizes the State Energy Resources Conservation and Development Commission to prescribe, by regulation, energy efficiency standards, including appliance efficiency standards. Pursuant to this authority, the commission has established regulations requiring solar-ready buildings and for the installation of photovoltaic systems meeting certain minimum requirements for low-rise residential buildings built on or after January 1, 2020. Existing law provides that these regulations shall be enforced by the building department of every city, county, or city and county.

This bill would, until January 1, 2030, suspend any existing regulation that requires a new single-family residential home to install a new photovoltaic system. This bill would provide that the building departments of every city, county, or city and county within the state are not required to enforce any existing regulation regarding the same. This bill would also, until January 1, 2030, prohibit the commission from adopting regulations for new single-family residential buildings requiring new photovoltaic systems that meet minimum qualification requirements, as described. This bill would render inoperative any regulation that imposes a requirement prohibited by these provisions. This bill would include related findings and declarations.

The people of the State of California do enact as follows:

SECTION 1.

The Legislature finds and declares that the cost of newly constructed single family housing in California has exceeded reasonable levels and that this cost could be decreased by suspending regulations from the California Building Standards Code that require all newly constructed single-family residences to install solar panels.

SEC. 2.

Section 25402.15 is added to the Public Resources Code, to read:

25402.15.

Until January 1, 2030, all of the following shall apply:

(a) Any existing regulation adopted by the commission that requires new single-family residential housing to install a new photovoltaic system is hereby suspended and is no longer operative. The building departments of every city, county, or city and county within the state are not required to enforce any existing regulation adopted by the commission that requires new single-family residential housing to install a new photovoltaic system.

(b) Notwithstanding any other provision of this chapter, the commission shall not have the authority to adopt regulations requiring new single-family residential buildings to install new photovoltaic systems, including, but not limited to, the minimum qualification requirements described in subdivision (c) of Section 150.1 of Chapter 8 (commencing with Section 100) of Part 6 of Title 24 of the California Code of Regulations. A regulation adopted by the commission that imposes this requirement shall be inoperative.
