An act to add Section 49452.6 to the Education Code, relating to pupil health.

SB 138, as amended, Roth. Pupil health: type 1 diabetes information: parent notification.

Existing law requires a school district to provide a type 2 diabetes information sheet developed by the State Department of Education to the parent or guardian of an incoming pupil in grade 7, as specified.

This bill would require the governing board of a school district and the governing body of a charter school to work with their schools that maintain any of kindergarten or grades 1 to 12, inclusive, to identify the most appropriate methods of informing parents and guardians of pupils of type 1 diabetes and to implement the identified methods by January 1, 2021. require the department to develop type 1 diabetes informational materials for the parents and guardians of pupils, as specified. The bill would require, on and after January 1, 2021, school districts and charter schools to make those materials available to the parent or guardian of a pupil while the pupil is enrolled in kindergarten or when the pupil is first enrolled in elementary school, and while the pupil is enrolled in grade 7. By imposing additional requirements on school districts and charter schools, the bill would impose a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:

SECTION 1.

Section 49452.6 is added to the Education Code, to read:

49452.6.
(a)The governing board of a school district and the governing body of a charter school shall work with their schools that maintain any of kindergarten or grades 1 to 12, inclusive, to identify the most appropriate methods of informing parents and guardians of pupils of type 1 diabetes.

49452.6.

(a) The department, in consultation with the governing boards of school districts and the governing bodies of charter schools that maintain any of kindergarten or grades 1 to 12, inclusive, and any other entity the department deems appropriate, shall develop type 1 diabetes informational materials for the parents and guardians of pupils.

(b) On and after January 1, 2021, the governing board of a school district and the governing body of a charter school shall make the type 1 diabetes informational materials accessible to the parent or guardian of a pupil while the pupil is enrolled in kindergarten or when the pupil is first enrolled in elementary school, and while the pupil is enrolled in grade 7.

(c) Information provided to parents and guardians pursuant to ~~subdivision (a)~~ this section may include, but shall not be limited to, all of the following:

(1) A description of type 1 diabetes.

(2) A description of the risk factors and warning signs associated with type 1 diabetes.

(3) A recommendation that pupils displaying warning signs associated with type 1 diabetes should be immediately screened for type 1 diabetes.

(4) A description of the screening process for type 1 diabetes.

~~(5)A description of type 1 diabetes and that after diagnosis, an endocrinologist is the preferred specialist for ongoing treatment.~~
(c)The governing board of a school district and the governing body of a charter school shall implement the methods identified pursuant to subdivision (a) in the schools that maintain any of kindergarten or grades 1 to 12, inclusive, by January 1, 2021.
(5) A recommendation that, after diagnosis, parents and guardians should consult with a medical care provider to determine if a specialist’s care is needed.

SEC. 2.

If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
