   An act to add Section 8509 to the Government Code, relating to
state government.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 1270, as introduced, De León. The Milton Marks "Little Hoover"
Commission on California State Government Organization and Economy.
   Existing law establishes the Milton Marks "Little Hoover"
Commission on California State Government Organization and Economy in
state government, with a specified membership to oversee the Bureau
of State Audits and assist the Governor and the Legislature to
promote efficiency in state government.
   This bill would prohibit a commissioner from serving on, or acting
as a chairperson of, a committee, or voting on any matter where the
commissioner has a conflict of interest or where the commissioner's
interest may cause a reasonable person to doubt the commissioner's
impartiality. This bill would also require the commission, on or
before July 1, 2013, to promulgate regulations to define a conflict
of interest and associated remedies.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 8509 is added to the Government Code, to read:
   8509.  (a) No commissioner may serve on, or act as a chairperson
of, a committee, nor vote on any matter where the commissioner has a
conflict of interest or where the commissioner's interest may cause a
reasonable person to doubt the commissioner's impartiality.
   (b) On or before July 1, 2013, the commission shall promulgate
regulations defining conflicts of interest of commissioners, and
shall prescribe remedies for a conflict of interest. Regulations
shall include, but not be limited to, actual or perceived conflicts
of interest arising from a commissioner's employment or financial
interests and prohibitions against serving on, or acting as a
chairperson of, a committee and voting.
