An act to amend Section 23401 of the Business and Professions Code, relating to alcoholic beverages.

SB 1114, as introduced, Allen. Alcoholic beverages: licenses.
The existing Alcoholic Beverage Control Act grants various rights and privileges to general on-sale licensees, including, with respect to wine and beer or other beverages mentioned in the license, the exercise of the rights and privileges granted by an off-sale beer and wine license, as specified.
This bill would provide that an on-sale general licensee may exercise the rights and privileges granted by an off-sale general license, with specified exceptions.

The people of the State of California do enact as follows:


SECTION 1.

 Section 23401 of the Business and Professions Code is amended to read:

23401.
 An on-sale general license, with respect to beer and wine, and any on-sale license, with respect to the particular beverage or beverages mentioned in the license, also authorizes the exercise of the rights and privileges granted by an off-sale beer and wine general license; provided, however, that a daily on-sale general license issued pursuant to Section 24045.1 shall not authorize the foregoing rights and privileges. None of the licensees mentioned in this section may, by reason of any license mentioned in this section, label, bottle, package, or refill any package with any alcoholic beverage.
