An act to add and repeal Article 3 (commencing with Section 42710) of Chapter 14 of Part 3 of Division 30 of the Public Resources Code, relating to state highways.

AB 981, as amended, Friedman.
State highways: pilot highway maintenance and rehabilitation demonstration projects.
Existing law vests the Department of Transportation with full possession and control of all state highways. Existing law requires the department to improve and maintain the state highways.
This bill would require the department, beginning in 2025 and ending in 2032, to use cold in-place recycling or partial depth recycling, as defined, on at least 12 projects each year. The bill would require the department, beginning in 2027 and ending in 2032, to use full depth recycling, as defined, on at least 2 5 projects each year. The bill would require the department to submit an annual report to the Legislature regarding these projects. The bill would repeal its
provisions on January 1, 2034.

The people of the State of California do enact as follows:
SECTION 1.
The Legislature finds and declares both of the following:(a) It is the policy of the State of California to reduce carbon emissions in the state’s transportation infrastructure and to use the urban quarry, which reduces the transportation of construction materials and increases the safety of construction sites by mitigating the impacts of construction vehicles in neighborhoods and communities.
(b) The increased use of partial depth recycling, full depth recycling, full depth reclamation, and cold in-place recycling methods on appropriate transportation projects will reduce carbon emissions,
increase safety, and reduce costs for California’s infrastructure.
SEC. 2.
Article 3 (commencing with Section 42710) is added to Chapter 14 of Part 3 of Division 30 of the Public Resources Code, to read:Article 3. Recycled Pavement Pilot

For the purposes of this article, the following definitions apply:(a) “Cold in-place recycling” means an on-grade method of pavement rehabilitation that consists of milling the existing asphalt concrete pavement to a depth between two and four inches, mixing the cold milled material with emulsified recycling agent and other additives as needed, spreading and compacting the recycled mixture, and overlaying the recycled surface with a new layer of hot mix asphalt. a pavement rehabilitation, reconstruction, or
corrective maintenance technique that recycles asphalt pavement without the application of heat.
(b) “Department” means the Department of Transportation.
(c) “Full depth recycling” or “full depth reclamation” means a pavement rehabilitation or reconstruction technique in which the full thickness of the asphalt pavement and a portion of the underlying layers, along with a small percentage of added cement, are pulverized to provide a homogeneous pavement material.
(d) “Partial depth recycling” means a pavement preservation and corrective maintenance technique that recycles asphalt pavement without the application of heat.

(a) The department shall, beginning in 2025 and ending in 2032, use cold in-place recycling or partial depth recycling on at least 12 projects each year.(b) The department shall, beginning in 2027 and ending in 2032, use full depth recycling on at least two five projects each year.
(c) The department shall consider all highway functional classifications, as classified by the Federal Highway Administration, when choosing projects for the
projects described in subdivisions (a) and (b).

(a) Notwithstanding Section 10231.5 of the Government Code, the department shall submit a report to the Legislature on or before January 1, 2026, and each year thereafter, regarding compliance with this article.(b) A report to be submitted pursuant to subdivision (a) shall be submitted in compliance with Section 9795 of the Government Code.
