An act to amend Section 9359.95 of the Government Code, relating to retirement.

AB 951, as introduced, Calderon. Legislators’ Retirement System.

The Legislators’ Retirement Law creates the Legislators’ Retirement System, which provides pension and other benefits to those members of the Legislature and specified state and statutory officers who have elected to become members. Existing California constitutional provisions prohibit the provision of retirement benefits to members of the Legislature and, on and after January 1, 2013, the Legislators’ Retirement System was closed generally to new members. The Legislators’ Retirement System pays a death benefit to members who, at the time of their deaths, are legislators.

This bill would make nonsubstantive changes to the above-described death benefit provisions of the Legislators’ Retirement System.

The people of the State of California do enact as follows:

SECTION 1.

Section 9359.95 of the Government Code is amended to read:

9359.95.

In addition to any other benefits provided for in this chapter, upon the death, on or after January 1, 1959, and before retirement, of any member who, at the time of ~~his or her~~ the member’s death was a legislator, there shall be paid to ~~his or her~~ their beneficiary, if ~~he or she~~ the member has designated one, and if not, to ~~his or her~~ their estate, an amount equal to the annual compensation payable to ~~him or her~~ the member during the 12 months immediately preceding ~~his or her~~ the member’s death.
