Budget Act of 2019. Courts.
(1) Existing law, upon appropriation by the Legislature, requires 100 additional new judges to be provided for and allocated to the various county superior courts pursuant to an appointment schedule that has a total number of 48 judges yet to be allocated.
This bill would specify that a certain item in the Budget Act of 2019 allocates 25 of the 48 judgeships effective in the 2019–20 fiscal year, thereby reducing the total number of judgeships yet to be allocated to 23.
(2) Existing law authorizes a trial court to carry over unexpended funds in an amount not to exceed 1% of the court’s operating budget from the prior fiscal year, and excludes specified revenue from the calculation
of that percentage.
This bill would conclude a trial court’s authority to carry over 1% of unexpended funds on June 30, 2019. The bill, commencing June 30, 2020, would authorize a trial court to carry over unexpended funds in an amount not to exceed 3% of the court’s operating budget from the prior year, excluding the same specified revenue from the calculation of that percentage as previously authorized.
(3) This bill would appropriate $5,514,000 from the General Fund to the Judicial Council to provide funding to implement technology solutions related to business intelligence and data analytics. The bill would make this amount available for encumbrance or expenditure until June 30, 2021.
(4) This bill would declare that it is to take effect immediately as a bill providing for appropriations related to the Budget Bill.
This bill would express the intent of the Legislature to enact statutory changes relating to the Budget Act of 2019.

The people of the State of California do enact as follows:
SECTION 1.
Section 69614.3 of the Government Code is amended to read:69614.3.
Upon appropriation by the Legislature, the 100 additional new judges provided for in Sections 69614 and 69614.2 shall be allocated to the various county superior courts, pursuant to the following appointment schedule:(a) On or before June 30, 2008, 40 additional judges shall be appointed.
(b) On or after July 1, 2008, 10 additional judges shall be appointed.
(c) On or after June 1, 2009, 50 additional judges shall be appointed.
(d) Notwithstanding subdivision (c), Item 0250-101-0932 in Section 2.00 of the Budget Act of 2018 (Chapter 29, Statutes of 2018) allocates two of the 50 judgeships to
the County of Riverside, effective July 1, 2018, thereby reducing the total number of judges to be allocated to 48.
(e) Notwithstanding subdivision (c), Item 0250-101-0932 in Section 2.00 of the Budget Act of 2019 allocates 25 of the 48 judgeships effective in the 2019–20 fiscal year, thereby reducing the total number of judgeships to be allocated to 23.
SEC. 2.
Section 77203 of the Government Code is amended to read:77203.
(a) Prior to June 30, 2014, a trial court may carry over all unexpended funds from the courts operating budget from the prior fiscal year.(b) Commencing June 30, 2014, and concluding June 30, 2019, a trial court may carry over unexpended funds in an amount not to exceed 1 percent of the court’s operating budget from the prior fiscal year. Commencing June 30, 2020, a trial court may carry over unexpended funds in an amount not to exceed 3 percent of the court’s operating budget from the prior fiscal year. The calculation of the 1 percent percentage authorized to be carried over from the previous fiscal year shall not include funds received by the court pursuant to the following:
(1) Section 470.5 of the Business and Professions Code.
(2) Section 116.230 of the Code of Civil Procedure, except for those funds transmitted to the Controller for deposit in the Trial Court Trust Fund pursuant to subdivision (h) of that section.
(3) Subdivision (f) of Section 13963, Sections 26731, 66006, 68090.8, 70640, 70678, and 76223, subdivision (b) of Section 77207.5, and subdivision (h) of Section 77209.
(4) The portion of filing
fees collected for conversion to micrographics pursuant to former Section 26863, as that section read immediately before its repeal, and Section 27361.4.
(5) Sections 1027 and 1463.007, subdivision (a) of Section 1463.22, and Sections 4750 and 6005, of the Penal Code.
(6) Sections 11205.2 and 40508.6 of the Vehicle Code.
SEC. 3.
The sum of five million five hundred fourteen thousand dollars ($5,514,000) is hereby appropriated from the General Fund to the Judicial Council to provide funding to implement technology solutions related to business intelligence and data analytics. This amount shall be available for encumbrance or expenditure until June 30, 2021.SEC. 4.
This act is a bill providing for appropriations related to the Budget Bill within the meaning of subdivision (e) of Section 12 of Article IV of the California Constitution, has been identified as related to the budget in the Budget Bill, and shall take effect immediately.It is the intent of the Legislature to enact statutory changes relating to the Budget Act of 2019.
