AB 884, as amended, Levine. ~~Local planning.~~ Dams and reservoirs: inspections.

Existing law requires the Department of Water Resources, from time to time, to make inspections of dams and reservoirs at state expense for the purpose of determining their safety.
This bill would require the department instead to make annual physical inspections.
Existing law establishes that there is in each city and county a planning agency with the powers necessary to carry out provisions of law relating to planning and land use. Existing law authorizes the legislative body of each city and county to assign the functions of the planning agency to a planning department, one or more planning commissions, administrative bodies or hearing officers, the legislative body itself, or any combination thereof, as it deems appropriate and necessary. Existing law authorizes a legislative body to establish for its planning agency any rules, procedures, or standards that do not conflict with state or federal laws.

The people of the State of California do enact as follows:

SECTION 1.

Section 6102 of the Water Code is amended to read:

6102.

The ~~department, from time to time,~~ department shall make annual physical inspections of dams and reservoirs at state expense for the purpose of determining their safety but shall require owners to perform at their expense such work as necessary to disclose information sufficient to enable the department to determine conditions of dams and reservoirs in regard to their safety and to perform at their expense other work necessary to secure maintenance and operation ~~which~~ that will safeguard life and property.

SECTION 1.Section 65102 of the Government Code is amended to read:
65102.
~~A legislative body may establish for its planning agency any rules, procedures, or standards that do not conflict with state or federal laws.~~
