AB 877, as amended, Gabriel.
Energy: solar energy and energy storage systems.
Under existing law, the Public Utilities Commission (PUC) has regulatory authority over public utilities, including electrical corporations. Decisions of the PUC adopted the California Solar Initiative, administered by the state’s 3 largest electrical corporations and subject to the PUC’s supervision. Existing law requires the PUC to ensure that not less than 10% of the funds for the California Solar Initiative are utilized for the installation of solar energy systems on low-income residential housing. Existing law requires the State Energy Resources Conservation and Development Commission (Energy Commission) to develop criteria for solar energy systems that receive ratepayer-funded incentives under the California Solar Initiative.
This bill would state the intent of the Legislature to authorize the Energy Commission to develop criteria for solar
energy systems and energy storage systems.
This bill would authorize the Energy Commission, in consultation with specified entities, to establish minimum requirements and develop rating standards for the performance and safety of a solar energy system that is not receiving ratepayer funded incentives and that is interconnected to the electrical distribution system.
This bill would authorize the Energy Commission, in consultation with specified entities, to establish minimum requirements and develop rating standards for the performance and safety of a battery storage unit or system intended to provide storage for energy generated by a solar energy system that is interconnected to the electrical distribution system. The
bill would authorize manufacturers of battery storage units or systems to request the Energy Commission to determine that a unit or system meets those requirements and standards. The bill would require the Energy Commission, upon a determination that a battery storage unit or system meets those requirements and standards to place that unit or system on a list of battery storage units or systems that meet the requirements and standards. The bill would require the Energy Commission to continuously update the list and make the list publicly available on its internet website. The bill would authorize the Energy Commission to charge and collect a reasonable fee from manufacturers making such requests to cover its costs for this program. The bill would require the collected fees to be deposited in the Energy Commission Equipment List Subaccount, which would be established by the bill. The bill would continuously appropriate the moneys in the subaccount to the Energy Commission to pay those costs.

The people of the State of California do enact as follows:
SECTION 1.
The heading of Chapter 5.1 (commencing with Section 25406) of Division 15 of the Public Resources Code is amended to read:
CHAPTER
5.1. Solar and Photovoltaic Solar, Photovoltaic, and Battery Systems
SEC. 2.
Section 25407 is added to the Public Resources Code, to read:25407.
The commission, in consultation with the Public Utilities Commission, electrical corporations, and local publicly owned electric utilities, may establish minimum requirements and develop rating standards for the performance and safety of a solar energy system that is not receiving ratepayer funded incentives and that is interconnected to the electrical distribution system of an electrical corporation or local publicly owned electric utility.SEC. 3.
Section 25408 is added to the Public Resources Code, to read:25408.
(a) The commission, in consultation with the Public Utilities Commission, electrical corporations, and local publicly owned electric utilities, may establish minimum requirements, including relevant definitions, and develop rating standards for the performance and safety of a battery storage unit or system intended to provide storage for energy generated by a solar energy system that is interconnected to the electrical distribution system of an electrical corporation or local publicly owned electric utility and that is used directly by a consumer to store energy at the generation site.(b) (1) A manufacturer of a battery storage unit or system may request the commission to determine that its unit or system meets the
minimum requirements and rating standards established pursuant to subdivision (a). Upon making that determination, the commission shall place the unit or system on a list of battery storage units and systems found to meet those requirements and standards. The commission shall continuously update the list and make it publicly available on its internet website.
(2) The commission may charge and collect a reasonable fee from those manufacturers of battery storage units and systems that make requests pursuant to paragraph (1) to cover the costs incurred by the commission pursuant to this section.
(c) (1) There is hereby established in the Energy Resources Programs Account the Energy Commission Equipment List Subaccount.
(2) The commission shall deposit all moneys received pursuant to this section
into the subaccount. Notwithstanding Section 13340 of the Government Code and Section 40182 of the Revenue and Taxation Code, and without regards to fiscal year, moneys in the subaccount are continuously appropriated to the commission for purposes of this section.
It is the intent of the Legislature to enact legislation to authorize the State Energy Resources Conservation and Development Commission to develop criteria for solar energy systems and energy storage systems.
