An act to add Section 4611 to the Vehicle Code, relating to vehicle registration.

AB 714, as introduced, Acosta. Vehicles: automatic registration renewal.
Under existing law, except as specified, every vehicle registration and registration card expires at midnight on the expiration date designated by the director and is required to be renewed prior to the expiration of the registration year. Existing law requires the Department of Motor Vehicles to renew a vehicle registration upon payment of the proper fees. Under existing law, renewal of registration for a currently registered vehicle may be obtained not more than 75 days prior to the expiration of the current registration.
This bill would require the department, by an unspecified date, to develop and implement an opt-in, automatic vehicle registration process. The bill would require the department to automatically bill a vehicle owner’s credit card for the renewal fee no more than 75 days prior to the expiration of the current registration. The bill would require the department to provide the vehicle owner with advance notice of the date of the scheduled renewal fee charge, as well as any additional information required by the department to complete the renewal. The bill would require the vehicle owner to use an alternative renewal method if he or she does not provide the department with the required additional information within a specified timeframe. The bill would require the department to adopt regulations governing the procedures for accepting automatic vehicle registration renewals.

The people of the State of California do enact as follows:


SECTION 1.

 Section 4611 is added to the Vehicle Code, to read:

4611.
 (a) No later than ____, the department shall develop and implement an automatic vehicle registration process pursuant to this section.
(b) The automatic renewal process shall be opt-in, allowing a vehicle owner to elect to provide the department with his or her credit card information for the purpose of renewal of his or her vehicle registration.
(c) (1) The vehicle owner’s credit card shall be automatically billed for the registration fee no more than 75 days prior to the expiration of the current registration. The department shall provide the vehicle owner with advance notice of renewal, including the date of the scheduled renewal fee charge.
(2) (A) If the vehicle owner is required to provide additional information in order to complete the registration, such as providing certification of the vehicle’s compliance with Part 5 (commencing with Section 43000) of Division 26 of the Health and Safety Code, the notice shall describe the additional information required, and advise the vehicle owner that his or her card will not be charged if the information is not received by the department ___ business days before the scheduled renewal fee charge date. The notice shall inform the vehicle owner that if he or she does not provide the required information within the specified timeframe, he or she is required to use an alternative renewal method.
(B) The automatic renewal process shall permit a vehicle owner to request and receive electronic-only notices under this section.
(d) The department shall adopt regulations governing the procedures for accepting automatic vehicle registration renewals pursuant to this section.
