    An act to add Section 3073.5 to the Penal Code, relating
to veterans.   An act to add Section 12804.11 to the
Vehicle Code, relating to vehicles. 


	LEGISLATIVE COUNSEL'S DIGEST


   AB 589, as amended, Cook.  Department of Corrections and
Rehabilitation: contracts: county veterans service officers:
incarcerated veterans.   Vehicles: driver's licenses and
identification cards: issuance and renewal: registered sex
offenders.  
   Existing law requires the Department of Motor Vehicles, upon
proper application, to issue driver's licenses and identification
cards.  
   Existing law requires a person convicted of certain sex offenses
to register with the chief of police or sheriff of the city or county
in which the person is residing or located, and with the chief of
police of a campus of the University of California, the California
State University, or community college if he or she is residing or
located upon the campus or in any of its facilities, within 5 working
days of coming into, or changing his or her residence or location.
This requirement applies for the rest of the person's life while
residing or present in this state.  
   This bill would require the Department of Motor Vehicles to issue
a distinctive original driver's license, identification card, or a
renewal of that driver's license or identification card that displays
a distinctive color, as specified, to a person required to be
registered as a sex offender. In addition to any other requirement,
the bill would require the applicant to provide a current photograph
and address verification to the department for the original license,
identification card, and for each renewal.  
   Existing law requires a county veterans service officer to assist
every veteran of any war of the United States and the dependents of
every deceased veteran in presenting and pursuing any claim the
veteran may have against the United States and in establishing the
veteran's right to any privilege, preference, care, or compensation
provided for by the laws of the United States or of this state.
 
   This bill would allow the Department of Corrections and
Rehabilitation or a local law enforcement agency to contract with
county veterans service officers in the county where the state or
local correctional facility is located to assist an incarcerated
veteran, as defined, and the veteran's dependents in presenting and
pursuing any claims, as specified, and in establishing the veteran's
and dependent's right to any privilege, preference, care, or
compensation provided for by the laws of the United States or of this
state. This bill would authorize the department or local enforcement
agency to, pursuant to the contract, compensate a county veterans
service officer for the assistance provided, as specified. The bill
provide that no more than 6 correctional facilities, as designated by
the department, may be the subject of these contracts.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 12804.11 is added to the 
 Vehicle Code   , to read:  
   12804.11.  (a) The department shall not issue an original driver's
license, driver's license renewal, identification card, or a renewal
of an identification card to a person required to be registered
under Section 290 of the Penal Code, except as authorized under this
section.
   (b) The department shall issue a distinctive driver's license or
identification card, or a renewal of that license or identification
card that displays a distinctive color or a distinctively colored
stripe or other distinguishing characteristic, to a person required
to register under Section 290 of the Penal Code. A person required to
register under Section 290 of the Penal Code shall carry his or her
driver's license or identification card issued by the department at
all times, outside of his or her place of residence.
   (c) In addition to any other requirement for a driver's license or
identification card, or a renewal of that license or identification
card, the department shall require the applicant to provide a current
photograph and address verification for the original license or
identification card, and for each renewal.  
  SECTION 1.    Section 3073.5 is added to the Penal
Code, to read:
   3073.5.  (a) The Department of Corrections and Rehabilitation or a
local law enforcement agency may contract with county veterans
service officers in the county where the state or local correctional
facility is located to assist an incarcerated veteran and the veteran'
s dependents in presenting and pursuing claims as the veteran and
dependent may have against the United States arising out of war
service and in establishing the veteran's and dependent's right to
any privilege, preference, care, or compensation provided for by the
laws of the United States or of this state. The department or local
enforcement agency may, pursuant to the contract, compensate a county
veterans service officer for the assistance provided at a rate of no
more than twenty thousand dollars ($20,000) annually.
   (b) No more than six correctional facilities, as designated by the
Department of Corrections and Rehabilitation, may be the subject of
contracts entered into pursuant to subdivision (a).
   (c) For purposes of this section, "incarcerated veteran" means a
veteran described in Section 920 of the Military and Veterans Code
who is incarcerated in a state or local correctional facility, but
does not include a veteran who has been dishonorably discharged or
who has a bad conduct discharge.
