An act to add Section 10334.1 to the Public Contract Code, relating to public contracts.

AB 458, as amended, Stefani.
Public contracts: firearms, ammunition, and firearm accessories.
Existing law generally regulates contracts entered into by any state agency for the acquisition of goods and requires public contracts to be awarded by competitive bidding pursuant to specified procedures.
This bill would require, no later than July 1, 2027, the Department of General Services, in consultation with the Department of Justice, to develop model guidelines for offices, officers, departments, divisions, boards, bureaus, and commissions of the state on the procurement of firearms, ammunition, and firearm accessories.

The people of the State of California do enact as follows:
SECTION 1.
Section 10334.1 is added to the Public Contract Code, immediately following Section 10334, to read:No
10334.1.
(a) For purposes of this section, “firearm accessory” has the same meaning as defined in Section 3273.50 of the Civil Code.
(b) No later than July 1, 2027, the Department of General Services, in consultation with the Department of Justice, shall develop model guidelines for offices, officers, departments, divisions, boards, bureaus, and commissions of the state on the procurement of firearms, ammunition, and firearm accessories. The purpose of the model
guidelines is to help state entities choose vendors and contractors for the procurement of firearms, ammunition, and firearm accessories that are in compliance with applicable local, state, and federal firearms laws.
