CALIFORNIA LEGISLATURE— 2019–2020 REGULAR SESSION

Assembly Bill
No. 3219

Introduced by Assembly Member Frazier

February 21, 2020

An act to add Section 916.5 to the Civil Code, relating to construction defects.

LEGISLATIVE COUNSEL'S DIGEST

AB 3219, as introduced, Frazier. Construction defects: actions.
Existing law specifies the requirements for actions for construction defects and includes a nonadversarial procedure for the parties to resolve the dispute. Existing law requires a builder who, as part of this nonadversarial procedure, elects to inspect a claim of unmet building standards to meet certain requirements for the inspection.
This bill would require that the inspection for purposes of the nonadversarial procedure be conducted by a person who is licensed as a contractor with a license that applies to the field and scope in which the person is conducting the inspection and issuing inspection findings or a report.
Vote: MAJORITY   Appropriation: NO   Fiscal Committee: NO   Local Program: NO

The people of the State of California do enact as follows:

SECTION 1.

Section 916.5 is added to the Civil Code, to read:

916.5.
An inspection conducted pursuant to this chapter shall be conducted by a person who is licensed pursuant to the Contractor’s State License Law (Chapter 9 (commencing with Section 7000) of Division 3 of the Business and Professions Code) with a license that applies to the field and scope in which the person is conducting the inspection and issuing inspection findings or a report.
