Existing law requires the Director of Forestry and Fire Protection to work cooperatively with other public agencies of local, state, and federal government to encourage these agencies to undertake forest resource improvement work, as provided. Existing law authorizes the director to enter into contracts or cooperative agreements with these agencies to provide, among other things, technical assistance and necessary supervisorial personnel. Under existing federal law, the United States Secretary of Agriculture, with respect to National Forest System land, and the United States Secretary of the Interior, with respect to Bureau of Land Management land, are authorized to enter into good neighbor agreements with a Governor to carry out specified forest, rangeland, and watershed restoration services, as provided.
This bill would establish in the State Treasury the Good Neighbor Authority Fund. The bill would authorize the moneys in the fund to be expended by the Department of Forestry and Fire Protection, upon appropriation by the Legislature, and to the extent not in conflict with federal law or a federal Good Neighbor Authority agreement, for the purposes of forest management. The bill would require the fund to be the depository for all revenue generated by state or local agencies through these agreements, to the extent not in conflict with federal law or a federal Good Neighbor Authority agreement, for the purposes of forest management.

The Highway Lighting District Act authorizes any unincorporated area in the state to be established as a highway lighting district for purposes of installing and maintaining a street lighting system on public highways. The act authorizes proceedings to form a highway lighting district to be instituted by filing a petition meeting certain requirements with the county board of supervisors. After completion of a specified protest proceeding, and in certain instances, the act requires the county board of supervisors to order an election to be held in the proposed district to determine if the district shall be formed.

This bill would make a nonsubstantive change to the latter provision.

The people of the State of California do enact as follows:


SECTION 1.

 Chapter 6 (commencing with Section 4810) is added to Part 2.5 of Division 4 of the Public Resources Code, to read:
CHAPTER  6. Good Neighbor Authority Fund

4810.
 (a) As used in this section, the following definitions apply:
(1) “Agreement” means the Good Neighbor Authority Agreement entered into between the state and the federal government pursuant to Section 2113a of Title 16 of the United States Code.
(2) “Fund” means the Good Neighbor Authority Fund, established pursuant to subdivision (b).
(b) There is hereby established in the State Treasury, the Good Neighbor Authority Fund. The moneys in the fund may be expended by the department only, upon appropriation by the Legislature, and to the extent not in conflict with federal law or an agreement, for the purposes of forest management.
(c) The fund shall be the depository for all revenue generated by state or local agencies through agreements, to the extent not in conflict with federal law or an agreement, for the purposes of forest management.

SECTION 1.Section 19090 of the Streets and Highways Code is amended to read:
19090.

Within 30 days after acquiring jurisdiction to proceed, the board of supervisors shall, by resolution, order that an election be held in the proposed district to determine whether or not the district shall be formed. The board may establish one or more voting precincts within the district and appoint one inspector, one judge, and two clerks residing in the district for each voting precinct to conduct the election, which shall be held on the next established election date not less than 130 days after the date of the resolution ordering it to be held.
