An act to add Section 12430 to the Government Code, relating to local government finance, and making an appropriation therefor.

AB 303, as introduced, Bigelow. City of Ione: police department: reimbursement.
Existing law prescribes the duties of the Controller, which generally regard supervision of the fiscal concerns of the state.
This bill would authorize the City of Ione to apply to the Controller for reimbursement of costs incurred by the Ione Police Department as a result of Mule Creek State Prison. The bill would require the Ione Police Department to prepare a statement of costs and to send the statement to the Controller for approval. The bill would require the Controller to reimburse the City of Ione, as specified, or provide a written statement as to the reason for not making the reimbursement. The bill would continuously appropriate, from the General Fund to the Controller, the amount necessary to reimburse the City of Ione.
This bill would make legislative findings and declarations as to the necessity of a special statute for the City of Ione.

The people of the State of California do enact as follows:


SECTION 1.

 Section 12430 is added to the Government Code, to read:

12430.
 (a) The City of Ione may apply to the Controller for reimbursement of costs incurred by the Ione Police Department as a result of Mule Creek State Prison.
(b) The Ione Police Department shall prepare a statement of costs that shall be reimbursed pursuant to this section. The statement shall be sent to the Controller for approval.
(c) (1) The Controller shall reimburse the City of Ione within 60 days after receipt of the statement required pursuant to subdivision (b) or provide a written statement as to the reason for not making the reimbursement at that time.
(2) Notwithstanding Section 13340 of the Government Code, there is hereby continuously appropriated, without regard to fiscal years, from the General Fund to the Controller the amount necessary to reimburse the City of Ione pursuant to this section.

SEC. 2.

 The Legislature finds and declares that a special statute is necessary and that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because of the need to reimburse the City of Ione for costs incurred by the Ione Police Department as a result of Mule Creek State Prison.
