An act to add Sections 3035 and 7152 to the Fish and Game Code, relating to fish and wildlife.

AB 293, as amended, Alanis. Lifetime hunting and sport fishing licenses: Gold Star Family members.
Existing law requires the Department of Fish and Wildlife to issue lifetime hunting licenses and lifetime sport fishing licenses, and grants certain lifetime privileges to holders of those licenses, upon the one-time payment of specified fees.
This bill would require, upon application to the department, lifetime hunting licenses and lifetime sport fishing licenses to be issued at no cost to Gold Star Family members who meet certain eligibility requirements.

The people of the State of California do enact as follows:


SECTION 1.

 Section 3035 is added to the Fish and Game Code, to read:

3035.
 (a) Upon application to the department’s headquarters office in Sacramento, an eligible Gold Star Family member shall be issued a lifetime hunting license at no cost.
(b) (1) A lifetime hunting license issued pursuant to this section shall afford the licenseholder the same privileges as a lifetime hunting license issued pursuant to Section 3031.2 and shall be subject to the same restrictions and requirements as a license issued pursuant to Section 3031.2.
(2) A lifetime hunting license issued pursuant to this section does not include any special tags, stamps, fees, validations, or other entitlements. A person holding a free lifetime hunting license may acquire any of the entitlements described in subdivisions (c) and (d) of Section 3031.2 upon payment of the applicable base fee, as adjusted pursuant to Section 713.
(c) A person applying for a free lifetime hunting license pursuant to this section shall submit to the department adequate documentation for the department to determine whether the person is eligible for the free lifetime hunting license. The department shall not issue a free lifetime hunting license to a person pursuant to this section unless it is satisfied that the person has provided adequate documentation of eligibility for that license.
(d) For purposes of this section, “eligible Gold Star Family member” means a person who meets all of the following requirements:
(1) The person has not been convicted of a violation of this code and is a resident of this state. code.
(2) The person submits proof to the department from the United States Department of Veterans Affairs or the United States Department of Defense that a family member who was in the Armed Forces of the United States was killed in the line of duty while on active duty in the military. is a resident of the state.
(3) The person submits satisfactory proof to the department that the person bears one of the following relationships to the family member described in paragraph (2): is eligible to receive a gold star lapel button pursuant to Section 1126 of Title 10 of the United States Code.

(A)Parent.

(B)Sibling.

(C)Child.

(D)Spouse or partner at the time the family member was killed.

SEC. 2.

 Section 7152 is added to the Fish and Game Code, to read:

7152.
 (a) Upon application to the department’s headquarters office in Sacramento, an eligible Gold Star Family member shall be issued a lifetime sport fishing license at no cost.
(b) (1) A lifetime sport fishing license issued pursuant to this section shall afford the licenseholder the same privileges as a lifetime sport fishing license issued pursuant to Section 7149.2 and shall be subject to the same restrictions and requirements as a license issued pursuant to Section 7149.2.
(2) A lifetime sport fishing license issued pursuant to this section does not include any special tags, stamps, fees, validations, or other entitlements. A person holding a free lifetime sport fishing license may acquire any of the entitlements described in subdivision (e) of Section 7149.2 upon payment of the applicable base fee, as adjusted pursuant to Section 713.
