An act to amend Section 92680 65000 of the Education Code, relating to the University of California. public elementary and secondary schools.

AB 2701, as amended, Cervantes. University of California: admission, enrollment, and graduation of California resident students. Public elementary and secondary schools: schoolsite councils.
Existing law requires local educational agencies, as defined, to adopt School Plans for Student Achievement as a condition of receiving certain state and federal funds. Existing law requires a school that operates a program that requires a School Plan for Student Achievement to establish a schoolsite council. At a secondary school, existing law requires the schoolsite council to consist of 2 groups: (1) the principal of the school or the principal’s designee, classroom teachers employed at the school, and school personnel employed at the school who are not teachers, with classroom teachers constituting a majority of the first group, and (2) parents of pupils attending the school, or other members of the school community, and pupils attending the school. Existing law requires that the number of persons selected for the second group equal the number of persons selected for the first group.
This bill would instead authorize the number of persons selected for the second group of a schoolsite council at a secondary school to exceed the number of persons selected for the first group.

The California Constitution provides that the University of California constitutes a public trust administered by the Regents of the University of California, a corporation in the form of a board, with full powers of organization and government, subject to legislative control only for specified purposes. Existing law defines “unduplicated pupils” as any pupil who is an English language learner, foster youth, or eligible for free or reduced-price meals. Existing law (1) expresses the intent of the Legislature that pupils in schools identified by the Superintendent of Public Instruction as having at least 75% unduplicated pupils in grades 9 to 12, inclusive, receive additional support to increase the number of those pupils who are admitted to, and enroll at, the University of California and who successfully complete an undergraduate degree within four academic years of freshman admission, and (2) require the University of California to approve a specified plan to enroll and support more of those students.

This bill would make nonsubstantive changes to the provisions relating to that statement of intent and relating to enrollment and support of students from those identified schools.

The people of the State of California do enact as follows:


SECTION 1.

 Section 65000 of the Education Code is amended to read:

65000.
 (a) It is the intent of the Legislature that, to the extent possible, the members of the schoolsite council represent the composition of the school’s pupil population. It is also the intent of the Legislature that, notwithstanding the size of the school, the composition of the schoolsite council ensure parity between the groups referenced in paragraphs (1) and (2) of subdivision (c).
(b) A school that operates a program that requires a School Plan for Student Achievement, pursuant to Section 64001, shall establish a schoolsite council.
(c) (1) At an elementary school, the schoolsite council shall consist of both of the following groups:
(A) The principal of the school or his or her the principal’s designee; classroom teachers employed at the school, selected by classroom teachers employed at the school; and school personnel employed at the school who are not teachers, selected by school personnel employed at the school who are not teachers. The classroom teachers selected pursuant to this subparagraph shall constitute a majority of the persons selected pursuant to this subparagraph.
(B) Parents of pupils attending the school, or other members of the school community, selected by parents of pupils attending the school. The number of persons selected pursuant to this subparagraph shall equal the number of persons selected pursuant to subparagraph (A).
(2) At a secondary school, the schoolsite council shall consist of both of the following groups:
(A) The principal of the school or his or her the principal’s designee; classroom teachers employed at the school, selected by classroom teachers employed at the school; and school personnel employed at the school who are not teachers, selected by school personnel employed at the school who are not teachers. The classroom teachers selected pursuant to this subparagraph shall constitute a majority of the persons selected pursuant to this subparagraph.
(B) Parents of pupils attending the school, or other members of the school community, selected by parents of pupils attending the school; and pupils attending the school, selected by pupils who are attending the school. The number of persons selected pursuant to this subparagraph shall equal or exceed the number of persons selected pursuant to subparagraph (A).
(d) An employee of a school who is also a parent or guardian of a pupil who attends a school other than the school of the parent’s or guardian’s employment is not disqualified by this employment from serving as a parent representative on the schoolsite council established for the school that his or her the parent’s or guardian’s child or ward attends.

SECTION 1.Section 92680 of the Education Code is amended to read:
92680.

(a)It is the intent of the Legislature that pupils who are enrolled in schools identified by the Superintendent of Public Instruction pursuant to subdivision (g) of Section 41580 receive additional support to increase the number of these pupils who are admitted to, and enroll at, the University of California and who complete successfully an undergraduate degree within four academic years of freshman admission.

(b)The University of California shall approve a plan, including a timeline, to do all of the following:

(1)Identify, in the files for each applicant for freshman admission, whether the applicant is enrolled in a school identified on the list developed by the Superintendent pursuant to subdivision (g) of Section 41580.

(2)(A)Provide direction to each campus regarding supplemental consideration in the admission process for pupils who are enrolled in schools identified pursuant to subdivision (g) of Section 41580 that comply with university policy.

(B)For the purposes of this paragraph, all pupils enrolled in schools identified pursuant to subdivision (g) of Section 41580 shall meet the same admission requirements as pupils who are enrolled in high schools not identified pursuant to subdivision (g) of Section 41580.

(3)Increase, at each campus and in each academic year, the number of California resident freshmen admits, including students meeting the requirements of Section 68130.5, who are enrolled at a school identified by the Superintendent pursuant to subdivision (g) of Section 41580. It is the intent of the Legislature that the University of California examine its practices to encourage more pupils who are enrolled at schools identified by the Superintendent pursuant to subdivision (g) of Section 41580 and who are admitted to the university to enroll at the university.

(4)Expand services and resources to be provided specifically for students who entered as freshmen and who were previously enrolled in a school identified by the Superintendent pursuant to subdivision (g) of Section 41580.

(c)No later than December 15, 2016, the university shall submit to the Director of Finance and the Legislature an evaluation of the costs and benefits of providing application fee waivers to applicants who are enrolled in schools identified by the Superintendent pursuant to subdivision (g) of Section 41580.

(d)No later than November 30 of each year, the university shall report to the Director of Finance and to the Legislature the number of pupils who attended a school identified by the Superintendent pursuant to subdivision (g) of Section 41580 and were admitted to the university, and the number of those students who enrolled, disaggregated by campus.

(e)This section is operative if funds are appropriated in the Budget Act of 2016 to the University of California.
