An act to amend Section 35010 of the Education Code, relating to school districts. 374 of the Financial Code, relating to financial institutions.

AB 2699, as amended, Ting. School districts: governing boards. Financial Institutions Law: commissioner: fees.
Existing law, the Financial Institutions Law, regulates the activities of various financial entities, including commercial banks, industrial banks, trust companies, credit unions, and savings and loan associations. The Financial Institutions Law is administered by the Department of Business Oversight, which is headed by the Commissioner of Business Oversight. Existing law authorizes the commissioner to charge a fee of $25 to approve any instrument and to affix his or her official seal to that instrument, and to charge a fee of $25 to, if requested, certify copies of documents.
This bill would, instead, authorize the commissioner to charge a fee of $30 to approve any instrument and to affix his or her official seal to that instrument or, if requested, to certify copies of documents, as described above.

Existing law establishes the system of public elementary and secondary schools in this state, and provides for their funding and governance. Existing law establishes school districts throughout the state to administer the public elementary and secondary schools within their respective jurisdictions. Existing law requires that every school district be under the control of a board of school trustees or a board of education and requires the governing board of each school district to prescribe and enforce rules not inconsistent with the law, or with the rules prescribed by the State Board of Education, for its own government.

This bill would make nonsubstantive changes to the latter provision.

The people of the State of California do enact as follows:


SECTION 1.

 Section 374 of the Financial Code is amended to read:

374.
 (a) Whenever it is necessary for the commissioner to approve any instrument and to affix his or her official seal thereto, the commissioner shall charge a fee of twenty-five dollars ($25) thirty dollars ($30) therefor.
(b) Whenever it is proper for the department to furnish a copy of any paper that has been filed therein and to certify to the paper, the commissioner may charge twenty-five cents ($0.25) for each page copied.
(c) Whenever the commissioner is required or requested to certify copies of documents, the commissioner may charge a fee of twenty-five dollars ($25) thirty dollars ($30) for certifying the copied documents and for affixing his or her official seal.

SECTION 1.Section 35010 of the Education Code is amended to read:
35010.

(a)Each school district shall be under the control of a board of school trustees or a board of education.

(b)The governing board of each school district shall prescribe and enforce rules not inconsistent with law, or with the rules prescribed by the state board, for its own government.
