An act to add Section 38532 to the Health and Safety Code, relating to greenhouse gases.

AB 2672, as introduced, Patterson. California Global Warming Solutions Act of 2006: wildfires.

The California Global Warming Solutions Act of 2006 designates the State Air Resources Board as the state agency charged with monitoring and regulating sources of emissions of greenhouse gases. The state board is required to approve a statewide greenhouse gas emissions limit equivalent to the statewide greenhouse gas emissions level in 1990 to be achieved by 2020 and to ensure that statewide greenhouse gas emissions are reduced to at least 40% below the 1990 level by 2030.

This bill would require the state board, in consultation with the Department of Forestry and Fire Protection, to annually submit a specified report to the Legislature that includes, among other things, an estimate of the annual emissions of greenhouse gases associated with wildfires in the state that have burned 10,000 acres or more and a direct comparison of that estimate to the emissions of greenhouse gases offset by the state board’s applicable regulatory programs.

The people of the State of California do enact as follows:

SECTION 1.

Section 38532 is added to the Health and Safety Code, to read:

38532.

(a) The state board, in consultation with the Department of Forestry and Fire Protection, shall annually report to the Legislature on all of the following:

(1) An estimate of the annual emissions of greenhouse gases associated with wildfires in the state that have burned 10,000 acres or more.

(2) A direct comparison of the data estimated pursuant to subdivision (a) to the emissions of greenhouse gases offset by the state board’s applicable regulatory programs.

(3) A list of the amount of moneys appropriated and allocated from the Greenhouse Gas Reduction Fund, created pursuant to Section 16428.8 of the Government Code, for vegetation management or fire risk reduction activities.

(b) A report to be submitted pursuant to subdivision (a) shall be submitted in compliance with Section 9795 of the Government Code.
