An act to amend Section 8570.4 of, and to add Section 8570.7 to, the Government Code, relating to emergency services.

AB 2428, as introduced, Fong. Emergency services: emergency and natural disaster preparedness: access and functional needs.
Existing law, the California Emergency Services Act, among other things, requires the Office of Emergency Services to update the State Emergency Plan on or before January 1, 2019, and every five years thereafter. The act also requires the office to develop a guidance document to specify the response of the state and its political subdivisions to agriculture-related disasters.
This bill would require the office to work with representatives from the access and functional needs population, as defined, when updating the State Emergency Plan. The bill would also require the office to develop and post, on or before July 1, 2021, on its internet website a guidance document regarding best practices for, and the lessons learned regarding, emergency and natural preparedness, for use by local governments. The bill would require the office to update and post this guidance document by July 1 of each year, commencing with the year 2022.

The people of the State of California do enact as follows:


SECTION 1.

 Section 8570.4 of the Government Code is amended to read:

8570.4.
 (a) The Office of Emergency Services shall update the State Emergency Plan on or before January 1, 2019, and every five years thereafter.
(b) (1) The office shall update the State Emergency Plan pursuant to subdivision (a) in coordination with representatives from the access and functional needs population, including, but not limited to, social service agencies, nonprofit organizations, and transportation providers, regarding the integration of access and functional needs into that plan.
(2) For purposes of this section, “access and functional needs population” has the same meaning as that in subdivision (b) of Section 8593.3.

SEC. 2.

 Section 8570.7 is added to the Government Code, to read:

8570.7.
 (a) On or before July 1, 2021, the Office of Emergency Services shall develop and post on its internet website a guidance document to the State Emergency Plan regarding best practices for, and the lessons learned regarding, emergency and natural disaster preparedness, for use by local governments.
(b) The office shall annually update, and post on the office’s internet website, the guidance document described in subdivision (a) by July 1 of each year, commencing with the year 2022.
