LEGISLATIVE COUNSEL'S DIGEST
AB 2399, as introduced, Voepel.
Defense: property used for defense.
Existing law allows a person or entity engaged in defense preparation who has property used for this purpose which he or she believes will be endangered if public use and travel is not restricted or prohibited on any abutting highway to petition the highway commissioners of any city or county to close or to restrict use of and travel upon any part of the abutting highway lying within 150 feet of the property. Upon receipt of a petition, existing law requires the highway commissioners to set a hearing and give a one-time notice in a newspaper of general circulation in the city or county in which the property is located at least 7 days prior to the date set for hearing.
This bill would instead require the notice to be given 14 days prior to the date set for hearing.
