   An act to amend Section  66201 of the Education Code,
relating to public postsecondary education.   94874.1 of
the Education Code, relating to private postsecondary education.




	LEGISLATIVE COUNSEL'S DIGEST


   AB 2316, as amended, Hueso.  Public postsecondary
education: admissions.   California Private
Postsecondary Education Act of 2009: exemption.  
   Existing law, the California Private Postsecondary Education Act
of 2009, provides, among other things, for student protections and
regulatory oversight of private postsecondary educational
institutions in the state. The act is enforced by the Bureau for
Private Postsecondary Education within the Department of Consumer
Affairs. The act provides several exemptions, including, but not
limited to, an exemption for an institution that is accredited by a
regional accrediting agency recognized by the United States
Department of Education, and does not hold a specified accreditation,
from specified provisions of the act until January 1, 2016. 

   This bill would provide that exemption shall apply only until
January 1, 2015.  
   Existing law states the intent of the Legislature that each
resident of California who has the capacity and motivation to benefit
from higher education should have the opportunity to enroll in an
institution of higher education.  
   This bill would make nonsubstantive changes to that statement.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 94874.1 of the   
 Education Code   is amended to read: 
   94874.1.  (a) An institution that is accredited by a regional
accrediting agency that is recognized by the United States Department
of Education, and is not an agency described in subdivision (i) of
Section 94874, is exempt from this chapter, except Article 14
(commencing with Section 94923).
   (b) This section shall remain in effect only until January 1,
 2016   2015  , and as of that date is
repealed, unless a later enacted statute, that is enacted before
January 1,  2016   2015  , deletes or
extends that date. 
  SECTION 1.    Section 66201 of the Education Code
is amended to read:
   66201.  (a) It is the intent of the Legislature that every
resident of California who has the capacity and motivation to benefit
from higher education should have the opportunity to enroll in an
institution of higher education. Once enrolled, an individual should
have the opportunity to continue as long and as far as his or her
capacity and motivation, as indicated by academic performance and
commitment to educational advancement, will lead him or her to meet
academic standards and institutional requirements.
   (b) The Legislature hereby reaffirms the commitment of the State
of California to provide an appropriate place in California public
higher education for every student who is willing and able to benefit
from attendance.
