Postsecondary education: sexual assault kits. Public health: postsecondary education: sexual assault kits.
Existing law establishes the California State University, under the administration of the Trustees of the California State University; the University of California, under the administration of the Regents of the University of California; independent institutions of higher education; and private postsecondary educational institutions as 4 segments of postsecondary education in this state.
This bill would require, on and after January 1, 2022, the California State University, the University of California, independent institutions of higher education, and private postsecondary educational institutions to ensure, for each of their respective campuses, that free sexual assault kits and related medical services are available to students. The bill would require the
free sexual assault kits and related medical services to be available onsite at the student health center if they are not available within a 5-mile radius for a campus located in an urbanized area, or within a 10-mile radius for a campus located in a rural area.
Existing law establishes the California Community Colleges, the California State University, the University of California, independent institutions of higher education, and private postsecondary educational institutions as the segments of postsecondary education in this state.
This bill would express the intent of the Legislature to enact later legislation that would require the California State University, the University of California, independent institutions of higher education, and private postsecondary educational institutions to ensure free sexual assault kits and related medical services are available within a 5-mile radius of each campus or to otherwise provide the same services to students for free at the campus health center.

The people of the State of California do enact as follows:
SECTION 1.
The heading of Article 1 (commencing with Section 99250) is added to Chapter 5.5 of Part 65 of Division 14 of Title 3 of the Education Code, to read:Article 1. Abortion by Medication Techniques
SEC. 2.
Section 99250 of the Education Code is amended to read:99250.
For the purposes of this(a) “Commission” means the Commission on the Status of Women and Girls established by Section 8241 of the Government Code.
(b) “Fund” means the College Student Health Center Sexual and Reproductive Health Preparation Fund established by Section 99251.
(c) “Grantee” means any qualifying student health center at a public college or university.
(d) “Medication abortion readiness” includes, but is not limited to, assessment of each individual clinic to determine facility and training needs before beginning to provide abortion by medication techniques, purchasing equipment, making facility improvements, establishing clinical protocols, creating patient educational materials, and training staff. “Medication abortion readiness” does not include the provision of abortion by medication techniques.
(e) “Public university student health center” means a clinic providing primary health care services to students that is located on the campus of a university within the University of California or California State University systems.
(f) “Public university system” means the University of California or the California State University.
SEC. 3.
Article 2 (commencing with Section 99270) is added to Chapter 5.5 of Part 65 of Division 14 of Title 3 of the Education Code, to read:Article 2. Sexual Assault Kits and Related Medical Services
99270.
(a) For purposes of this section, the following definitions apply:(1) “Independent institution of higher education” means a nonpublic higher education institution as defined in Section 66010.
(2) “Private postsecondary educational institution” means an institution as defined in Section 94858.
(3) “Related medical services” includes, but is not limited to, a sexual assault examination.
(4) “Student health center” means a clinic providing primary health care services to students that is located on the campus of a university within the University of
California or California State University systems, or on the campus of an independent institution of higher education or a private postsecondary educational institution.
(5) “Urbanized area” means an incorporated city or an urbanized area or urban cluster as defined by the United States Census Bureau.
(6) “Rural area” means any portion of a county or the state that is not an urbanized area.
(b) On and after January 1, 2022, the California State University, the University of California, each independent institution of higher education, and each private postsecondary educational institution, shall ensure that sexual assault kits and related medical services are available and are free of cost to students of their respective campuses, as follows:
(1) For
each campus located in an urbanized area, the kits and related medical services are available within a five-mile radius of the campus or shall be offered onsite at the student health center.
(2) For each campus located in a rural area, the kits and related medical services are available within a 10-mile radius of the campus or shall be offered onsite at the student health center.
It is the intent of the Legislature to enact later legislation that would require the California State University, the University of California, independent institutions of higher education, and private postsecondary educational institutions to ensure free sexual assault kits and related medical services are available within a five-mile radius of each campus or to otherwise provide the same services to students for free at the campus health center.
