An act to add Section 13308.10 to the Government Code, relating to the state budget.

State budget.
Existing law requires the Governor to submit to the Legislature, within the first 10 days of each calendar year, a budget for the ensuing fiscal year. Existing law requires the Director of Finance to provide to the Legislature, on or before February 1 of each year, all proposed statutory changes necessary to implement the Governor’s Budget.
This bill would require the Director of Finance, if the director proposes to limit the operation of a recently amended or added statute as a part of the budget process described above, to, at the same time that the director proposes statutory changes to the Legislature, notify the author of the bill that last amended or added that statute, the Senate Committee on Budget and Fiscal Review, the Assembly Committee on Budget, and the relevant policy committees of the Legislature of the proposed changes in
writing. The bill would also define various terms for the purposes of these provisions.

The people of the State of California do enact as follows:
SECTION 1.
Section 13308.10 is added to the Government Code, to read:13308.10.
(a) If, as a part of the statutory changes that the Director of Finance proposes to implement the Governor’s Budget pursuant to subdivision (b) of Section 13308, the Director of Finance proposes to limit the operation of a recently amended or added statute, the Director of Finance shall, at the same time provided in subdivision (b) of Section 13308, notify the author of the bill that last amended or added that statute, the Senate Committee on Budget and Fiscal Review, the Assembly Committee on Budget, and the relevant policy committees of the Legislature of the proposed changes in writing.(b) For purposes of this section:
(1) “Author” means the first lead author of the bill, or if the author was a committee, the committee. If the first lead author of the bill is no longer a Member of the Legislature, the director shall provide the notice described in subdivision (a) to the
relevant rules committee for forwarding to the last known home address of that author.
(2) “Limit the operation” means any proposed statutory change that would make a requirement or authorization in a recently enacted or amended statute operative contingent upon later appropriation of funds by the Legislature or limited to funds that were appropriated in prior years.
(3) “Recently amended or added statute” means a statute that was last amended, or added, by a bill that was chaptered, in either a regular session or an extraordinary session, within the two immediately preceding calendar years, and the changes proposed by the Director of Finance relate to those provisions last amended or added during that time period.
This does not include a bill authored by the Senate Committee on Budget and Fiscal Review, the Assembly Committee on Budget, or a bill that contains a section declaring it is related to the Budget Bill within the meaning of subdivision (e) of Section 12 of Article IV of the California Constitution.
