Existing law establishes the Mental Health Student Services Act as a mental health partnership competitive grant program for the purpose of establishing mental health partnerships between a county’s mental health or behavioral health departments and school districts, charter schools, and the county office of education within the county. Existing law requires the Mental Health Services Oversight and Accountability Commission to establish criteria for the grant program and requires that applicants for the program submit a plan that, among other things, describes the need for mental health services for children and youth, including campus-based mental health services.
This bill would require a school district, charter school, or county office of education awarded a grant under the program to ensure that an individual hired with grant funds to provide mental health services to children and youth holds a current and valid license from the Board of Behavioral Sciences, as specified.
Existing law, the Lanterman Developmental Disabilities Services Act, requires the State Department of Developmental Services to contract with regional centers to provide services and supports to individuals with developmental disabilities and their families. Existing law requires the department and the regional centers to annually collaborate to determine the most appropriate methods to collect and compile meaningful data in a uniform manner relating to the payment of copayments, coinsurance, and deductibles by each regional center.

The people of the State of California do enact as follows:

SECTION 1.

Section 5887 is added to the Welfare and Institutions Code, to read:

5887.
A school district, charter school, or county office of education awarded a grant pursuant Section 5886 shall ensure that an individual hired with grant funds to provide mental health services to children and youth holds one of the following current and valid licenses from the Board of Behavioral Sciences:
(a) Clinical social worker.
(b) Educational psychologist.
(c) Professional clinical counselor.

SECTION 1.Section 4519.6 of the Welfare and Institutions Code is amended to read:
4519.6.
The department and the regional centers shall annually collaborate to determine the most appropriate methods to collect and compile meaningful data in a uniform manner, as specified in Section 4519.5, relating to the payment of copayments, coinsurance, and deductibles by each regional center.
