   An act to add  Section 13570 to the Water  
Chapter 14 (commencing with Section 25995) to Division 15 o 
 f the Public Resources  Code, relating to water.

   AB 2076, as amended, Cristina Garcia. Water  recycling:
beer and wine.   and energy use efficiency:
certification: breweries.  
   Existing law establishes the CalConserve Water Use Efficiency
Revolving Fund and provides that the moneys in the fund are available
to the Department of Water Resources, upon appropriation by the
Legislature, for the purpose of water use efficiency projects. 

   Existing law, the Alcoholic Beverage Control Act, establishes the
Department of Alcoholic Beverage Control for the regulation and
licensure of activities related to alcoholic beverages.  
   This bill would require the Department of Water Resources, in
consultation with the California brewing industry, to develop water
and energy use efficiency certification guidelines for the production
of beer that include, among other things, uniform standards for the
industry's use of efficiency certification seals and would require
the Department of Alcoholic Beverage Control to consult in label
design and approval for the use of a seal on a beer bottle. The bill
would require an applicant for water and energy use efficiency
certification to submit an application to the Department of Water
Resources and, in accordance with the guidelines, would require the
department to review the application and approve or disapprove the
certification of the brewery within an unspecified time. The bill
would require each application for certification to be accompanied by
an application fee to recover costs incurred by the Department of
Water Resources for the efficiency certification.  
   Existing law requires the State Water Resources Control Board to
establish uniform statewide recycling criteria for each varying type
of use of recycled water where the use involves the protection of
public health.  
   This bill would require the board to adopt uniform water recycling
criteria for the use of recycled water in the manufacture of beer
and wine.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Chapter 14 (commencing with Section
25995) is added to Division 15 of the   Public Resources
Code   , to read:  
      CHAPTER 14.  BREWERY WATER AND ENERGY USE EFFICIENCY
CERTIFICATION


   25995.  The Department of Water Resources, in consultation with
the California brewing industry, shall develop water and energy use
efficiency certification guidelines for the production of beer that
include all of the following:
   (a) Three tiers of certification with the highest tier being gold,
the next tier being silver, and the lowest tier being bronze.
   (b) Seals designed for each tier of certification.
   (c) Uniform standards for the industry's use of seals, including,
but not limited to, on the label of a bottle or on the outside of a
manufacturing plant. The Department of Alcoholic Beverage Control
shall consult in label design and approval for the use of a seal on a
beer bottle.
   25996.  (a) An applicant for water and energy use efficiency
certification shall submit an application to the Department of Water
Resources. In accordance with the guidelines established pursuant to
Section 25995, the department shall review the application and
approve or disapprove the certification of the brewery within ______.

   (b) Each application submitted pursuant to this section shall be
accompanied by an application fee to recover costs incurred by the
Department of Water Resources for the efficiency certification.
Consistent with Section 3 of Article XIII A of the California
Constitution, the department shall set the fee in an amount
sufficient to recover all reasonable regulatory costs incurred for
the purposes of this chapter.  
  SECTION 1.    Section 13570 is added to the Water
Code, to read:
   13570.  The state board shall adopt uniform water recycling
criteria for the use of recycled water in the manufacture of beer and
wine.
