An act to amend Section 11006 8604 of the Elections Code, relating to elections.

Recall election. Elections: write-in candidates.
Existing law generally prohibits requiring a write-in candidate for office to pay a fee or charge. Existing law requires other candidates to pay a filing fee or to submit a petition containing signatures of registered voters instead of a filing fee, as specified.
This bill would require a write-in candidate for a voter-nominated office who advances to the general election to pay the prescribed filing fee in order to appear on the general election ballot.
Existing law provides procedures for the recall of elected officers.
This bill would make technical, nonsubstantive changes to these provisions.

The people of the State of California do enact as follows:
SECTION 1.
Section 8604 of the Elections Code is amended to read:8604.
(b) A write-in candidate for a voter-nominated office who receives the highest or second highest number of votes cast at the primary election shall pay the filing fee prescribed by Section 8103 to the Secretary of State to appear on the ballot at the ensuing general election.
Proceedings may be commenced for the recall of any elective officer, including an officer appointed in lieu of an election or to fill a vacancy, by the service, filing, and publication or posting of a notice of intention to circulate a recall petition pursuant to this chapter.
