An act to add Chapter 3.5 (commencing with Section 127610) to Part 2 of Division 107 of the Health and Safety Code, relating to patient billing.

Medical billing task force.
Existing law establishes the Office of Statewide Health Planning and Development (OSHPD) to perform various functions and duties with respect to health facilities, health professions development, and health policy and planning. Existing law requires OSHPD to consult with the Insurance Commissioner, the Director of the Department of Managed Health Care, and others to adopt a California uniform billing form format for professional health care services and a California uniform billing form format for institutional provider services. Existing law requires OSHPD to adopt the California uniform billing form formats to be used in all health care payment programs it administers, including Medi-Cal.
This bill would require OSHPD, in consultation with the Insurance Commissioner, to establish a medical billing task force on or before April 1, 2020. The bill
would require the task force to, among other things, engage interested parties in the development of a system to improve the readability of medical bills and create a standard medical billing form. The bill would require OSHPD, on or before December 1, 2020, to submit a report to the Legislature on the task force’s efforts.

The people of the State of California do enact as follows:
SECTION 1.
Chapter 3.5 (commencing with Section 127610) is added to Part 2 of Division 107 of the Health and Safety Code, to read:CHAPTER 3.5. Medical Billing Task Force
127610.
(a) It is the intent of the Legislature to ensure California consumers can better understand the services they are being billed for after a medical visit.(b) On or before April 1, 2020, the office, in consultation with the Insurance Commissioner, shall establish a medical billing task force.
(c) The task force shall do all of the following:
(1) Engage interested parties in the development of a system to improve the readability of medical bills for consumers.
(2) Create a standard medical billing form to be used by a health care entity.
(3) Provide for greater certainty of medical bill requirements by a health care entity.
(d) On or before December 1, 2020, the office shall prepare and submit a report of findings based on the efforts of the task force to the appropriate policy and fiscal committees of the Legislature. The report shall be submitted in compliance with Section 9795 of the Government Code.
(e) As used in this section, “health care entity” includes a professional person, medical group, independent practice association, organization, health facility, or other person or institution licensed or authorized by the state to deliver or furnish health care services, a health care service plan licensed pursuant to the Knox-Keene Health Care Service Plan Act of 1975 (Chapter 2.2 (commencing with Section 1340) of Division 2), and a health insurer
writing health insurance, as defined in Section 106 of the Insurance Code.
