An act to add Section 9005 to the Government Code, relating to the Legislature.

AB 1434, as introduced, Travis Allen. Legislature.

The California Constitution requires each house of the Legislature to judge the qualifications of its Members, and authorizes each house to suspend or expel a member with a ²/₃ vote.

This bill would prohibit a Member of the Legislature from simultaneously serving as an officer of a labor union, and would prohibit a Member who violates this prohibition from exercising the powers of his or her office as a Member of the Legislature until he or she resigns from the union office.

The people of the State of California do enact as follows:

SECTION 1.

Section 9005 is added to the Government Code, to read:

9005.

(a) A Member of the Legislature shall not simultaneously serve as an officer of a labor union.

(b) A Member who violates subdivision (a) shall not exercise any of the powers of his or her office as a Member of the Legislature.

(c) A Member who is subject to subdivision (b) may, upon resigning from his or her position as an officer in a labor union, resume exercising the powers of his or her office as a Member of the Legislature.
