BILL NUMBER: AB 1389 INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Blumenfield FEBRUARY 27, 2009 An act to amend Section 193 of the Streets and Highways Code, relating to highways. LEGISLATIVE COUNSEL'S DIGEST AB 1389, as introduced, Blumenfield. State highways. Existing law provides that the state highway system consists of the routes authorized by law. Existing law authorizes the California Transportation Commission to select, adopt, and determine the location for state highways on routes authorized by law. Existing law provides that the money in the State Highway Account that is available each year for state highways shall be expended by the Department of Transportation to acquire real property for, and to make improvements to, the state highway system on the locations determined by the commission, and to construct or improve highways in state parks in the manner provided by law. This bill would make a nonsubstantive change to these provisions. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. AB 1389, as introduced, Blumenfield. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 193 of the Streets and Highways Code is amended to read: 193. The State Highway Account money allocated and available each year for state highways shall be expended by the department: (a) On the locations determined by the commission on routes authorized by law , to acquire the necessary real property or interests therein for, and to construct or improve to standards justified by traffic requirements, the state highways in the state highway system. (b) To construct or improve highways in state parks in the manner provided by law. SECTION 1. Section 193 of the Streets and Highways Code is amended to read: 193. The State Highway Account money allocated and available each year for state highways shall be expended by the department: (a) On the locations determined by the commission on routes authorized by law , to acquire the necessary real property or interests therein for, and to construct or improve to standards justified by traffic requirements, the state highways in the state highway system.
