An act to add Chapter 5.8 (commencing with Section 11549.20) to Part 1 of Division 3 of Title 2 of the Government Code, relating to state government identification.

Existing law requires the Department of Motor Vehicles to issue a driver’s license to an applicant when the department determines that the applicant is lawfully entitled to a license. Existing law also authorizes the Department of Motor Vehicles to issue an identification card to any person attesting to the true full name, correct age, and other identifying data as certified by the applicant for the identification card. Existing law authorizes a person who has been issued a driver’s license or identification card by the department to use it as a form of identification for various purposes.

This bill would establish the California E-Identity Program Task Force within the Government Operations Agency. The bill would require the Secretary of Government Operations to appoint 10 people to serve as the members of the task force. The bill would require the task force to study the development of an e-identity program within California, and to report its findings to the Legislature by January 1, 2019.

The people of the State of California do enact as follows:

SECTION 1.

Chapter 5.8 (commencing with Section 11549.20) is added to Part 1 of Division 3 of Title 2 of the Government Code, to read:

CHAPTER 5.8. California E-Identity Program Task Force

11549.20.

There is hereby established, within the Government Operations Agency, the California E-Identity Program Task Force.

11549.21.

The Secretary of Government Operations shall appoint 10 people to serve as the members of the task force. All persons appointed pursuant to this section shall have demonstrated private sector experience in the field of electronic identity, cyber security, and related fields.

11549.22.

(a) The task force shall study the development of an e-identity program within California. The task force shall develop the initial technical framework of an e-identity program that accomplishes all of the following objectives:

(1) It is security protected.

(2) It is transparent to the user.

(3) It can be used as a valid form of identification for both business and government transactions.

(4) It can be used as an initial gateway to access government services.

(b) The task force shall establish a timeline to determine when both Phase 1 and Phase 2 of the e-identity program could be implemented. Phase 1 of the program would establish a purely digital identification with a private security code that would allow for independent verification of signatures of legal documents. Phase 2 would, in part, move the responsibility to issue identification cards from the Department of General Services to the Government Operations Agency.
