AN ACT TO ESTABLISH THE "MOBILE PERSONAL HYGIENE PILOT PROGRAM ACT OF 2018"; TO PROVIDE THAT PILOT PROGRAM SHALL BE A THREE-YEAR PROGRAM ADMINISTERED BY THE JACKSON STATE UNIVERSITY SCHOOL OF PUBLIC HEALTH IN CONJUNCTION WITH THE AARON AND OLLYE SHIRLEY FOUNDATION; TO REQUIRE THE UNIVERSITY AND THE FOUNDATION TO ENTER INTO A MEMORANDUM OF UNDERSTANDING FOR THE DONATION, USE, MAINTENANCE AND GARAGING OF A CIRCULATOR BUS, OR OTHER UNIVERSITY-OWNED OR FOUNDATION-OWNED VEHICLE APPROPRIATE FOR THE PURPOSE OF THE PILOT PROGRAM, TO BE USED AS THE MOBILE PERSONAL HYGIENE FACILITY; TO REQUIRE AN ANNUAL REPORT TO BE SUBMITTED TO THE LEGISLATURE AND TO THE MISSISSIPPI INTERAGENCY COUNCIL ON HOMELESSNESS; TO ESTABLISH IN THE STATE TREASURY A SPECIAL FUND TO BE DESIGNATED AS THE MOBILE PERSONAL HYGIENE FACILITY FUND; TO PROVIDE FOR FUNDING TO THE PILOT PROGRAM ON A PHASED-IN BASIS THROUGH LEGISLATIVE APPROPRIATION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  This act shall be known, and may be cited, as the "Mobile Personal Hygiene Pilot Program Act of 2018."

     SECTION 2.  (1)  (a)  There is established within the Jackson State University School of Public Health a three-year mobile personal hygiene pilot program, hereinafter referred to as the "pilot program," to provide a mobile facility that travels throughout the State of Mississippi and provides shower and bathroom facilities to individuals who are homeless, to enable such individuals to tend to their personal hygiene.

          (b)  The pilot program shall be administered by the Jackson State University School of Public Health, in conjunction with the Aaron and Ollye Shirley Foundation.

          (c)  The pilot program shall be implemented within sixty (60) days of the effective date of this act and shall continue for three (3) years, subject to the availability of funds appropriated by the Legislature under Section 4 of this act, or funds received by the university as a gift, donation or bequest for such purposes.

     (2)  (a)  Jackson State University School of Public Health and the Aaron and Ollye Shirley Foundation shall enter into a memorandum of understanding for the donation, use, maintenance and garaging of a circulator bus, or other university-owned or foundation-owned vehicle appropriate for the purpose of the pilot program, to be used as the mobile personal hygiene facility, whether the bus or other vehicle is donated in-kind by the university, the foundation or another third-party entity, whether private or public.

          (b)  Based on the availability of funds authorized under subsection (1)(c) of this section and deposited into the Mobile Personal Hygiene Facility Fund established under Section 4 of this act to implement the pilot program, funds may be used for the purposes of:

                   1.  Converting, retrofitting and equipping the bus or other vehicle for use as a mobile personal hygiene facility;

                   2.  Operating the mobile personal hygiene facility for the duration of the pilot program period; and

                   3.  The collection of data and report preparation as required by Section 3 of this act.

     SECTION 3.  By July 1, 2019, and annually thereafter for the duration of the pilot program, the Jackson State University School of Public Health, in conjunction with the Aaron and Ollye Shirley Foundation, shall prepare and submit a report of the data collected to the House Public Health and Human Services Committee, the House and Senate Appropriations Committees, the Senate Public Health and Welfare Committee and the Mississippi Interagency Council on Homelessness on the status of the pilot program.  The report shall include:

          (a)  The number of homeless individuals served;

          (b)  The number of staff required to implement and operate the pilot program;

          (c)  The cost of operating the pilot program;

          (d)  An analysis of the effectiveness of the pilot program;

          (e)  Recommendations to improve the pilot program; and

          (f)  Projections as to the cost of implementing and expanding the pilot program to a permanent program to meet the needs of the entire state.

     SECTION 4.  (1)  There is established in the State Treasury a special fund to be designated as the Mobile Personal Hygiene Facility Fund, which shall be administered by the Dean of the Jackson State University School of Public Health in accordance with subsection (2) of this section.  The fund shall consist of revenues received and deposited from:

          (a)  Funds appropriated for the purposes of the act;

          (b)  Donations from the public;

          (c)  Donations from private entities;

          (d)  Funds provided through a sponsorship agreement; and

          (e)  Any funds remaining from the allocations authorized by Section 2(2)(b) of this act.

     (2)  (a)  Monies in the fund shall be used to implement, operate, and administer the pilot program.  Except as provided in paragraph (b) of this subsection, the monies deposited into the fund, and interest earned, shall not lapse into the State General Fund at the end of a fiscal year.

          (b)  All monies in the fund not expended or obligated upon the termination of the pilot program shall lapse into the State General Fund, provided that if the pilot program is continued or implemented as a permanent program, the monies in the fund shall remain in the fund or be transferred to a fund established for the permanent program, whichever is applicable.

     (3)  The Legislature shall appropriate funds to implement the "Mobile Personal Hygiene Pilot Program Act of 2018" on a phased-in basis with each phase based on a state appropriation of not less than Three Hundred Thousand Dollars ($300,000.00) for each fiscal year of the pilot program.  The first phase of appropriation funding shall be used to fund the cost of implementing and operating the Mobile Personal Hygiene Pilot Program, collecting data and reporting the collected data to the legislative committees and the Mississippi Interagency Council on Homelessness as required by Section 3 of this act.  Future annual phases shall be based on interest in and the effectiveness of the pilot program.

     SECTION 5.  This act shall take effect and be in force from and after July 1, 2018.
